Most likely, the child will need the father's consent to get a passport.  Father unknown on DS-160.  Father named on BC.  Oh, he's also a US citizen.  She's kinda sorta maybe maybe not the child of a US citizen.  You don't think the US Consulate will want to know about the father?  Especially when the child is seeking a visa?  

No CO in their right mind is going to issue a visa for that child.  

I am trying to figure out where would "inconsistency and lies" appear on a DS160. The online form is pretty straight forward when asking for surnames as listed on the child's passport. The family section asks for biological data and has a don't know option. Where is the lie here?

The consulate does not need the applicant's BC for a visitor visa.

However, the CO will want to know about the father during the interview before giving the child a visa to enter the US.    This is where the problem lies.

 

Good intentions have led to bad results.  Don't dig further with good intentions.  Get competent legal help to straighten it all out.

Then if it is so straightforward, why is it that no lawyer consulted so far want to take the case?

Yup.

 

Exactly like someone who adopts a niece with two live biological parents and then comes on VJ asking how to get an immigration visa for an adopted child.   Then, we tell them they can't and people accuse us of being negative and bad for telling the truth.
