Seems I came late to the party. I cannot view the letters from his first post. Tried different browsers but NADA. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

what is his next step? Is he allow to work while in the process of filing for appealing or during the appealing process??

 

i don’t know much about removing condition to give him any guidance. 
 

p.s. he didn’t mention to his lawyer that him and his spouse were no longer together until right before the interview. I have attached the pictures of his denial letter

I sure appreciate all the input that everyone has given. As far as pictures from original post goes, I have removed them because there was his A# at the end of the letter that I didn't crop out, so here is the letter  without that info.

 

It was a real marriage for my friend and his spouse to those who is wondering. They are still good friends hence the reason why his spouse showed up at the interview and supported him.

 

My friend definitely didn’t want to lie and wanted to be honest at the interview about the separation. He filed for removing condition when they were still together and had no clue that divorce paper could have helped his case at the interview nor that he had any knowledge about the divorce waiver prior the interview otherwise he could have done so. I agreed that he should have informed his lawyer about the separation , which was definitely a wrong move on his part. The reason his spouse removed himself from the application because the lady who was interviewing them suggested him to do so and suggested that my friend should refile with the divorce paper or try to reconcile. What done is done at this point, all my friend can do right now is to refile the application correctly and filing for divorce.  He is working with the lawyer for the next steps going forward so hopefully it all works out.

 

Thanks again for everyone input on this, truly appreciate it.  🙏

Yeah, so I am very confident in stating that despite the 'clear language' in the letter, and as much as USCIS would love it to be, the letter is not the law..... as stated (again) the OPs friend has absolute rights in law, and remains a LPR until those rights and processes have been explored and carried out. 

 

I'll refrain from posting further as I'll get myself banned.

There is no need to be so condescending.  You and others stated that my posts were rubbish, and that I was fearmongering.  

 

I'm relieved on behalf of the OP that the USCIS is full of it, and there is nothing to worry about.  Hopefully he will confirm this down the road.

I will also back you up in this.  Because of not being familiar with the process during my wifes entering the US and GC application we hired a very experienced immigration lawyer.   Removed a lot of stress but also allowed me to get questions answered in detail that aren't in black and white to the lay person.

 

He told us that if it's just paperwork (ie, no crime, fraud, falsification of documents) and someone comes in on a family based GC that once someone is in the US in over 20 years of doing immigration law he had only ONE case in which his client got removed.  In that case his client had blatant lied on an application and had filed a previous fraudulent.

 

Punchline:  Once someone is here on a GC its VERY hard to to be removed.    To anyone in that predicament you can't afford NOT to get a lawyer so you don't make mistakes.   VJ is a great resource but I'd lawyer up if I got a denial or case started getting complicated beyond something like wrong fees or missing info.

OP - not sure what state your friend is in, but make sure your friend and their soon-to-be ex look at the possibility of a no contest divorce.  Some states can speed those divorces through REDICULOSLY fast.  A dear friend of mine in Idaho had their divorce done in like a month because it was no contest.

Yes they will file as no contest divorce. My friend will probably file in NJ. When i filed back in 2014 for mine, it didn’t take that long either so hopefully it won’t be that long but with covid i don’t know how long things take these days.
