I765 expedite request

Hi all, 

Need suggestions on my situation. 

I'm 35 weeks pregnant and due to deliver in January first week. My husband's l1 visa extension of 240 days is going to be over on January 2nd. 

We had filed a family petition for I765, I 485 and I 131 in July 2021 and got the biometrics done in September 2021. 

Post January 2nd, my husband has to go for unpaid leaves till he receives approved EAD, so financially he will have 3 dependents to take care of without a job(me, my 5yr old and new born). Also both of our DL will expire in January (based on 240 days expiration of visa extension), which can't be renewed further till we have approved EAD

 

We put an expedite request to USCIS from my husband's application number,based on above scenario(stating my pregnancy and DL expiration), which got rejected(we didn't provide any proofs, nor did they ask during the telephonic conversation).

 

Now we again want to put an expedite request through my application number, along with doctor's letter and employer letter and financial strain condition on the family.

 

Can anyone share their experience of expediting the application, along with suggestions that might help in our case?

I'm confused.  Are you a USC?  Why can you not renew your DL?  What sort of visa is he adjusting from?

 

Pregnancy is not a reason to expedite.  Any expedite request that is not accompanied by evidentiary documentation is bound to be denied.

We need to move out of country to apply for visa and that would scrap our I-765 and I-131 processing, we already have been 5 months in the process. 

Also I can't travel at this point of time, atleast for the next 2.5 months, considering my last stage of pregnancy and new born passport application will take atleast 6 weeks .

 

We do want to submit the proofs, but we were not provided with any email id or fax no to provide the supporting documents.

 

Has anyone got the process expedited in the last 6 months?

Financial strain is the way to go. Reach out to your US Senator or US Congressperson. State your case and they will help you. 
USCIS does not always ask for evidence. Plenty of people get approved without any evidence. Just place request to expedite again, and reach out to your US Senator or US congressperson. This time around ask for a fax number, email or an address where you can send your evidence.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

FYI advice like this is the reason why USCIS is bombarded with expedite requests with people expediting secretly hoping that USCIS will not ask evidence. Do you have experience in this? I have experience. USCIS will ask you to fax evidence to them. “Plenty of people got approve”…..do you have concrete proof of this? 

 

USCIS always asks for proof. They may not have ask in the past but not anymore. They will not blindly approve it without proof.

LOL, this site. @Richa sahni like I said, pursue the expedite. They may or may not ask for evidence. Be ready to present your evidence. Often times the call ends and people don't even ask for a fax number or email. Do whatever you need to do to get your EAD and to sleep in peace.

My guess is they they are here on a L1 and L2 and have also been sponsored by a family member. L is running out, PD being now current they have filed to adjust. So currently still work authorised.

 

Must admit I do not know how someone who applies for an expedite based on a possible future issue is treated.

Yes, that's right . 

We are on L1 and L2 and the extension period is running out for that.

We have all the proofs, but didn't had any fax no or email id to provide the proofs.

Both mine n my husband's request had been declined.

Now we are going through a lawyer.

Let's see if this works.
