Thank you all very much for your input, I appreciate your thoughts and points of view. I will be sending off our petition in the next 24 hours and will be sure to give you an update on what the USCIS decides.

I think they are saying that since they are still the spouse of a US Citizen, they can refile for Adjustment of Status and the result would be a 10 year green card (if approved) because of the length of the marriage? I am not sure if that is actually true, but I believe that is what Mike E was referring to.

I’m in the correct thread. I am explaining what can happen when an I-751 is denied.  Thanks for your concern though.

Remember to include evidence since the date of your marriage. If you COVID took a toll on your mental health and you missed the deadline, state that. They're not going to remove you. You will be fine. 

 

Your I-751 is already late. I would spend an extra second making sure that all your bases are covered.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

Even if there was a compelling reason, a simple letter explaining it together with documentation is something that OP can draft. IMHO, no need for an attorney at this point.

In my opinion, immigration law is very difficult. If you have no problems and have a straightforward case, you can probably get away with DIY forms and applications. 

 

Once a mistake is made, or a level of complication is added, then, consulting with an attorney at the onset  may save you thousands of dollars afterwards.  We don't  know what we don't know.  A qualified attorney may have seen many similar cases and knows what works, and what doesn't, and they have been trained to use legalese in their letters.

I have seen more attorneys make GIANT mistakes than I have individuals, but hey, if you have money to blow.

Exactly. A lot of attorneys are there just for the money, and they make BRUTAL mistakes. The truth is, nobody really cares about your immigration journey as much as you do.

Personally, I prefer to read about immigration and consult forums with people that have first hand experience.

Hi everyone!

 

Just thought I would give an update on this!

 

I sent off my i-751 packet on 12/4 and received a text notification that it had been received on 12/11. 

 

On 12/21, I received my NOA in the mail letting me know that the document was okay to be used as proof of residency and to travel for the next 24 months while they are processing the i-751. I guess this is an indication that they accepted my packet & I will not be getting deported! Very relieved about this!

 

For those of you who are interested, I did submit my packet with a cover letter apologizing that I was filing late (by about 11 weeks) and that 2021 had been a difficult year for me after being diagnosed with anxiety and depression. I did include a letter from my doctor that said it was reasonable for someone with that diagnosis to miss an important deadline like this.

 

Sending good luck to everyone going through the immigration process!

Thanks for the update.  As I said, you are neither the first nor the last to file an I-751 late.  Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
