We finally got an interview next month but it is 1 month before our marriage anniversary. The interview date also falls between our planned travel outside the United States. I have a couple basic questions:

 

  • When we call them to reschedule, could the planned travel be a strong enough excuse for them to approve it? How do we make sure the postponed interview falls after our 2 year marriage anniversary?
  • For people who have traveled outside the US on their combo card (travel/work), has it been easy to come back to the US or does it warrant some questioning? (my spouse is currently employed, if it matters)

2/3 times that my wife used her combo card she was sent to secondary.  There were zero questions.  
 

1/3 times she was not sent to secondary but it was a preclearance station (Abu Dhabi).  She was questioned: “where is your husband?”

 

I’ve never heard of CBP denying admission to an AP holder.  I’ve heard of airlines denting boarding.

 

And I’ve heard of people who lose their AP documents.  Only one has ever reported a successfully outcome.

What else did your wife carry besides the combo card? Better to be safe by carrying copies of the official letters sent by USCIS (NOA, I-693, interview notice, etc)?

 

We actually return 10 days after the currently scheduled interview but 3 weeks before our 2 year marriage anniversary. Do I just state that I may be gone for longer and I would prefer a date in February?

Her passport.

Gotcha. I guess we'll carry those. Better to be safe than sorry!

Answers to your questions:

1. I do not think that they have ever denied a request to reschedule. Just say it is an emergency. Done. 

2. My husband went to his home country by himself back in 2019. He did not have any issues upon his return. They took him to secondary inspection but that is normal. He was very nervous but as I told him repeatedly, no one needs to be nervous unless you are a wanted criminal, etc. Going to secondary is normal. They asked him where I was. He said at work. "Why didn't he travel with you?" He told them I could not take the time off. I kept my phone handy just in case CBP needed to call me or whatever, but that was not necessary either. Everything was fine. 

 

If they reschedule you for a date before your 10 year anniversary, honestly, just reschedule again. It is worth not having to file the I-751 to remove conditions. By the way, they did not ask him for marriage certificate but he had a copy of it, as well as a copy of the I485 and combo card I797s.

Be safe, the new variant is no joke.

So happy for you! I remember your case. You were asking at one point how to get your case moving with a congressman etc. You waited for over 1 year to get the interview. The wildcard is USCIS. I have read nightmare cases where someone is regretting rescheduling as it may or may not add months to your case. Whatever you decide, I hope everything goes well for you! If this were up to me, I would not miss my interview and get it over with but that’s just me :). Good luck.

If its first interview the it makes more sense to have it after 2 yrs anniversary to avoid another paerwork and/or interview :)


BTW, When & where did you you file, and how long it took to get the interview?

You mean, having interview after 2nd marriage anniversary &  if approved he'll get 10 year GC. Right?

 

But is it okay to reschedule multiple times? It won't effect the case?

If USCIS adjudicates the case after the 2nd year marriage anniversary, he'll get the 10 year green card. To be clear, what matters is when USCIS adjudicates/makes a decision on your case. You can interview a month before your 2 year marriage anniversary and say, USCIS takes 4 months to make a decision, then you would get a 10 year card because the decision was made AFTER your 2 year anniversary. :)

I said the "reschedule however many times" more tongue-in-cheek. He will probably only need to reschedule once. 

USCIS won't reschedule him right away. It seems they do things in cycles. And remember, they schedule people 4-6 weeks out. So if he cancels now, appts for the next 6 weeks are probably already set. So that's the imaginary speculative calculation that I am doing. (I do not have a source for it).

Seems like this really went downhill for us. I was able to call and get the interview rescheduled before traveling overseas but there was still no appointment letter when I came back two weeks later. Another two weeks later and I'm looking at a denial notice for failing to appear for the interview despite the online case status saying that the interview was rescheduled.

 

Cannot get the contact center to have me speak with a Tier-2 officer nor schedule an Infopass appointment to meet with an officer.

Yes, that happens sometimes. I would keep calling. I would also reach out to your US Senator or US Congressperson ASAP.
