Hi everyone, I’m the petitioner and about to send in my I-129f for my fiancé from Armenia.I can’t stop worrying about everything and haven’t slept in days 

 

When I was 19 I was arrested and charged for shoplifting at Macys.

 

I obviously marked yes for question 4b and I attached a sheet describing the incident and that i take full responsibility and remain remorseful to this day, and that I have never broken the law on any other occasion.

 

I also have the certified court disposition.

 

Could this delay my case, trigger an RFE and ultimately result in a denial?

I don’t see how a presumably non-violent (you were unarmed right?) misdemeanor conviction . would affect your I-129F

 

Has your criminal record limited your job prospects and hence income? If so, that is your bigger worry.

I don’t think you have anything to worry about. As long as you disclose it correctly like the form asks then you’ll be fine. Good luck!

This is why you have to read the Adam Walsh Act. The only offense that would prevent a USC to petition for their fiancé is an offense involving a minor:

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

I honestly don’t think they’ll grill him. At most they can ask him if he’s aware of this, so make sure he knows the details. You did the right thing by answering the truth and presenting the police certificate. There’s not much more you can do!

At K-1 interviews beneficiaries sometimes get asks if they are aware of criminal history of petitioners

I would bet cash money that it won't even come up in the interview.  

 

With more serious criminal backgrounds for petitioners, they often will bring it up during the interview, as a measure of how "well" the two parties know each other:  i.e, did the petitioner disclose that part of their life to the beneficiary?

 

I really don't think you need to lose any more sleep over this.  Best of luck!
