Hello,

I’m currently out of the country (in Morocco with my husband), and I was wondering if I’m allowed to file an i130 online? 
I am currently unemployed but as soon as I go back to the states I will be looking for a job. I used to work as an RN, but I currently took a mental break and will be returning to that line of work when I get back. I was looking at the i130 form and it asks for employment, and I know the i864 isn’t filled until the paper work goes to the NVC. I know by that time i already will have a job and would be working for a while. I will be going back next month and starting a job. Would it look bad to put unemployed on the i130? Should I wait until I go back to the states and get a job and then file? 

any input would be really helpful!

Yes,  apply online 

put in the most current employment dates / nothing will be needed to show income for 18 to 24 months

u dont' have to wait / many take time off (especially during or after covid) 

 

there's a lot to know for getting approved in Casa so please when u file , create a timeline / it helps VJ community to know how to answer some of your queries

and be sure to add your spouse to 2021 tax returns as Casa expects u to start commingling assets

u r married now and need to file as married MFJ or MFS /   file a 2555 form to exclude any moroccan income

 

Follow IRS sites to know this proceedure about the W7 form and supporting documents needed

A joint sponsor is not needed when the I-130 is submitted.  Also, the I-130 applicant has to be the main sponsor, whether employed or not.

Fill in your employment history.  I believe that information on the I-130 is used mainly for background checks.
