Avidavid of suport I 864 or I 134 ?

hello everyone

we filled our petition for K1 ,way before I was member of this great site here and I didnt know where to go for advice ,so I just noticed back then I gave my fiance the I 864 avidavide of suport to download, we send it in and got our NOA 2 aproved from VTC as well as NVC , my question is since they arpoved it are we ok with the I 864 form or do we have to download the I 134 for the consulate in montreal? and what exactly is the differance on those forms? they both look pretty much the same , any advice would be apriciated thank you Lona

On March 9, 2010, we ordered production of your new card.

12 March 2010 received approval letter in mail

16 March 2010 10 year Green Card received in mail exp date March 09 / 2020

April 14/2017 send N400 

04/25/17 credit card charged 

04/25/17 e mail NOA send 

05/01/17 hard copy of NOA dated 04/25 received in mail

05/06/17 biometric hard copy in mail 

05/19/17 Biometric appointment in Hartford CT 

07/17/17 Inline for Interview 

07/24/17 Interview letter in mail 

08/24/17 Interview in Springfield MA ... Yes Aproved

09/14/17 Oath Ceremony .... done I am a US citizen

09/22/17 Applied for Passport ( per reg mail ) 

10/04/17 got passport in mail  

10/13/17 got certificate in mail  , updated status with social security office 

AM DONE YEAHHHHHHHHHHH

K-Visas use I-134 for the Visa interview at the consulate, K-visas are considered to be Non-Immigrant visas and nonimmigrant visas use I-134. Only immigrant visas like CR-1, and IR-1 use I-864 at the consulate because they directly result in a Green-Card.

K-Visa holders use the I-864 when adjusting status in the USA.

I-864 is for green-card, I-134 is for NON-Immigrant visa.

hello everyone

No. They just ignored your I-864 form because they didn't need it. The USC should send the visa applicant a fresh I-134 and supporting documents to take to the interview. They may or may not be asked for but it will have nothing to do with the fact you earlier submitted unnecessary forms.

Facts are cheap...knowing how to use them is precious...

Ok thank you for the help I got another question , it states that the I 134 has to be notorized can my fiance have it notorized by his bank since they have all his financuel information there ,( they did Notorize important documents for him in the past when we calld that was the only place where he lives where they notorize documents )

Yes can have a notary at the bank witness his signing the form.

Also: bank statements are only needed is you are using a savings account as an asset, if your income is above 125% poverty line the don't bother listing assets, they are more concerned with income.

In our case this what the I-134 included.

  • I-134 signed and notarized.
  • Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS
  • Photo copy of IRS form 1040, and W2s for past 3 years
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past 6 months pay stubs up to a few weeks before the interview.

NO you do not need to show bank statements, they are only needed when income is below 125% poverty line to show assets to make up a short fall.

If you list the asset things the consular officer then just has more to ask questions about and you will have to provide more financial evidence. I have bank accounts, 401k and other things but did not list them on the I-134.
