a couple of questions about K3 and Tourist visa

A friend of my husband's married this Turkish girl and he just came back to the States...but.....he didnt do any DCF, or apply for a K3...nothing...he thinks he can get her here with a tourist visa and then apply for AOS...My question was....is it possible??? can it be that "simple" ??? cause i told him she cant visit USA if they got married...they have to apply for some type of visa....except the tourist one :blush:

06/30/09 : Greencard received!!! NO MISTAKES!!!

04/12/2010 : N-400 package sent...fingers crossed for a fast approval.....

06/07/2010 : Biometrics in Orlando

08/09/2010: Citizenship interview - PASSED!!!!

08/13/2010 : OATH Ceremony - Finally a US citizen and DONE with USCIS!!!!

if he does that then it will be visa fraud... he needs to do either DCF or K3... if she was to get past POE and they try to do AOS they will get denided and she will have to return to her home country...

Get him to go to his local USCIS office and ask about it....

if they want to do things completely legally with no possible consequences of her being denied entry and/or adjustment, his best bet would be to petition for the CR1 and/or the K3 visa. She cannot enter the US with a tourist visa and then adjust status, they're already married, she can't use a tourist visa with intent to immigrate.

thank you kezzie and reba....you proved me right...now i have to talk some senses into that guy, that is better to file for a K3 or CR 1 :)
