I-864 unemployed sponsor asset evidence questions

Hi, I have some questions regarding I-864 and would appreciate the help/advice!  

 

My fiancé entered US with K1 visa last month and we just got married. Now we are filing for AOS. Since I am currently unemployed, I am wondering what kind of supporting documents I need submit with I-864 to use assets to cover the requirement? I have downloaded

• Tax transcripts of 2020, 2019, and 2018 (with 50K+ income each year)
• Bank Statements of the most recent six months
• Stock account (not retirement plan) statements of the most recent six months

Our household size is 2, so the 125% of HHS Poverty Guidelines is $21,775 for 2021. Does that mean the combined balance of my bank account and stock account need to be greater than $108,875 (5 x $21,775) to meet the requirement?

Other than the above three sets of documents, what else I should send with I-864?

Hi, 

 

I submitted the petition on May and was facing the same situation as you.

 

I suggest it’s better to prepare 12 months bank and stock account statement as 6-months may cause rfe.

 

Besides, 3x 125% of annual income according to poverty guideline should be sufficient for marriage based green card applicants, but of course more is better.

Thanks! I will get 12 months statements. And you meant assets more than 3x 125% of poverty guideline should be sufficient? or annual income?

Asset more than 3x 125% of poverty guideline, but I would say more is better

That's a lot of statements to be sent. Can I send them in double-sided copies, or all the forms and support documents have to be single-sided?

I don’t think if there is any requirement for the forms and docs to be single or doubled sided but I rmb I use double sided for forms and docs. I think it’s just up to you

I-864 Part 6. question 7. "My current individual annual income", Since unemployed, did you enter "0" or you count in other income such as unemployment benefits and interests/dividends? Thanks!

My situation was same as you and I didn’t entered any unemployment benefit or interests/dividends as I don’t know if they are qualified as “income” so I included assets only. USCIS only accept income or asset for i864 but you cannot use both. If you include asset in i864 rmb to include 12-months as USCIS will count 12-month average

Thanks. I just put "0" there. 

One more silly question, there is no where in I-864 shows the sponsor is the spouse of the immigrant, I am wondering how the officer know 5x or 3x of the 125% of poverty guideline is sufficient?
