Hi.

I moved to the States from Canada in 2008 on a K1 Fiance visa. My ex-husband and I regretfully divorced in 2018. I have been searching for my place and purpose since this time. I'm currently not working and I'm trying to find out what it is I want to do with my life. I'm 40 years old and debating going back to school. A huge part of me thinks it's time I move back to Canada to be near my family and their support.

The question is, do I just let my green card status expire and leave America behind or do I file? Is it even worth it to become a citizen if I'm not technically going to be living here? Can I file in the state I'm in now and then move back to Canada while it processes and return for the test and oath ceremony? I always saw myself living part time in Canada and part time in the US in the future but now I just don't know. I know it's taking roughly over a year for citizenship but I just don't know if it would even be worth it now.

Any guidance or insight would be greatly appreciated. I was once pretty active on these boards.

Thanks.

Your status doesn’t expire.  The more time you spend outside the USA the higher the probability of a notice to appear where your status will be considered for revocation

Only you can decide to become a citizen or not.

Being a citizen gives you an absolute right to come and go as you please.

“move” implies yielding your sweeping and taking up residence outside the USA.

1. giving you your residence makes you ineligible to naturalize

2. as it takes over 180 days for most N-400 cases to get to interview, at your interview you will report that you have been absent for 181 days or more.  You will likely be denied naturalization

you can visit Canada for 180 days or less while keeping your residence in the USA.  After you file should spend at least 50 percent of your time in the USA to minimize the risk of denial.

i feel that you deserve your citizenship as you cam in good faith and not your fault that you and your ex husband did not work out, i say its best to do it now while you can and it will be a much easier process for you as getting your citizenship can take some time, plus you can end up finding another love of your life in the states and you dont want to go through the whole k1 process again,
