I need to help my little step-son

Timeline

My step son was born in Jan 2002 in Mexico. I want to petition for him to come live with us. My husband moved to the US in Sep 99 so he was not there to be added onto the Birthcertificate. I have called the Registro Civil and the consultate and either we don't understand each other or they don't call back. I just talked to a guy today, but he did not understand what I was asking (this was a call to Registro Civil in MX). I have called and emailed the consultate and no reply.

Without the name on the BC I can not prove to be his step mother and can not file the petition. Please help. Anyone know how I can submit to add my husbands name to the BC? This little boy is mistreated by his birth mother. He is 7 years old and will not even talk to her. He talks to me and my husband a little bit on the phone, but if she comes around he stops talking. Any suggestions on what to do? We are about to file my husbands I-130 next week so he can not return to MX to make the change.

Do you mean January 2000? Only way I can make sense of your timelines.

First question is whether his birth mother will agree.

Has the father had a paternity test? Is there court ordered child support?

Opps yes I mean 2000. The mother has agreed. She does not want my step son at all. She will not let us take his daughter, but she has already told us to "get that stupid child out of here". So I would take that as agreement to let us take the child. We had planned on taking them both anyways before she called my step son names. We just received his BC and my husbands name is not on it. To do a paternity test I think we will have to either go there or bring his son here and that will require a visa. My husband does not pay child support he just sends about $300 each month to her.

It really upsets me because my stepson is mistreated. He was burned by her cigarette recently because he made her mad. He will not talk at all around her and I hate to see children get hurt. I was really excited when I got the BC's, but now I am just frustrated. I am still waiting for answers from the consultate, but I don't have faith in that unless I go to the office.

I would make sure you have her agreement in writing, legally.

Probably best bet is to have a word with a local family lawyer.

For you to petition him I would expect that you need to demonstrate the family connection, and you have no documentation to support that.
