Wife's brother in Poland is getting married, what to do? AP/I-131 topic

Timeline

Well they have not really lost anything if they abandon the process, apart from the filing fees.

OP never stated he filed I-130.

OP wants it both ways.. the ability to for his wife to live and work in Poland with the "shorter" AOS timeline in the States... 

Multiple posters have suggested his wife a) misses her brother's wedding and waits for her GC/ EAD &AP  in the States or b) abandons AOS and moves back to Poland and undergoes consular processing

but he doesn't like either suggestion. 

OP and the wife want to move back to Poland in May to work a wedding before her brother's wedding (In late June) while maintaining her place in line for AOS

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Again, he just stated he "filed with the I-485".  We are filling in "filled I-130 and I-130a with the I-485" for him.  "With the I-485" could also mean "with the form I-485" and only I-485.

 

It would be helpful to know what specific forms were filed and when.

 

@kloisha, Did you file the following forms?  If so, were they all filed the same time last week?

 

- I-130

- I-130a

- I-1485

- I-131

Exactly.  Maybe he was implying that the I-130 was filed with the I-485.

I directly asked if he filed the I-130/I-130A before the I-485 or with it and he replied "with"...

maybe he misunderstood my question... either way I know OP doesn't want to wait in line for consular processing but also wants his wife to be able to work and travel to/in Poland while she waits for her AP/EAD/ and GC....

There is the chance of Expedited AP. and I am a big proponent of applying. I have sen some weird cases approved.

 

Relying on it happening is another matter.

Green card processing times nationally are close to two years.

OP - lots of our questions here could have been avoided if you also filed out a timeline here.  I hope you filed the I-130 and all of the suggested optional items when the I-485 was filed.

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

We have got freedom of choice, but every choice has consequences. You will have to make a  choice of what's important, choose whether to forgo her traveling for wedding or for her to leave the country and start over. Pick your poison.

i applied for AP/EAD in nov 2020 just got a decision. so roughly 12-16 months. 7 months is like hoping for a miracle of hudson
