Hello All,

We are starting our I-751, Petition to Remove Conditions on Residence right now, and I have a question about WORK AUTHORIZATION. The WORK AUTHORIZATION for my spouse has expired and we forgot to renew it.

 

Does anyone know HOW WE CAN RENEW OUR WORK AUTHORIZATION WHILE WE ARE DOING OUR I-751?

EAD is not renewed/ useless after you get GC. So, NO you don't need it anymore and USCIS won't renew it since you already had a GC.

 

Send your I-751 and you'll get an extension of your GC while you await for its (I-751) adjudication. This extension allows you to work. 

 

When you do an I-751, it is the GC that expired, not your status.

If your spouse has a green card your spouse has work authorization. 
 

The EAD card is useless.  
 

Has the green card expired?

 

If so your focus needs to be on sending your I-751,

like tonight.

To add on the bolded for OP:

 

1. Use attached link to determine exactly when your eligibility window opens. More often, people send and it gets rejected for filing early.

 

2. Do not and I mean, do not, file same day your eligibility opens. File a week in.

Hopefully you have the SS card with no restrictions listed on it. That plus valid DL is all that’s needed for proof of being able to work. HR can’t tell you what types of documents to provide to them (ie if they want green card only that’s illegal).

I have a ss card with restrictions on it.  How do I remove it?

You bring your green card to an SSA office and file SS-5 

 

In some locales, SSA will illegally require you to mail or drop off your green card.  It should be obvious that you should not do that.  And to be clear: do not do that under any circumstances.  You never ever allow your green card out of your possession except to a DHS officer.

Oh boy. I had a whole argument last week about why would someone need to wait some days after the opening of the 90 day windows to file for ROCZ. Good thing I’m not the only one giving that advice!

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

May 1, 2020 Card in hand

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

You don’t need to renew the work authorization. In fact, it is void once you receive your green card. Should your wife change jobs, she can absolutely present the i-797 extension letter for proof of status.

We all give that advice but people are "file happy." They can't wait to file. It becomes worse with online N400 filing...at exactly 12.00.01 they file 🤦🏽‍♂️
