Hi all! As I was getting the paperwork to send out, I re-read everything on the guides and had forgotten about the affidavits that must be sent with the I-130 confirming our marriage and relationship. According to the copied statement below, who does one use as a third party to affirm their statement? My mother and one of my Uncles want to do this but do they write their statement, and sign in the presence of each other? Is that what that means?

Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage);

Anyone can be a third party, they just have to know you.

As far as how its signed, I don't believe they have to be notarized, so the affidavit merely should be signed by the person themselves. I don't believe a witness is required.

I would get them notarized to be safe. But, that is not required. Some members have submitted a simple sworn statement.

03/12/2007 - Married to my beautiful wife

04/16/2007 - Sent I-130 to VSC via USPS Express Mail

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.

Thanks for your fast replies!! That makes it so much easier to get them back ASAP since they live in another state. They wanted to fax them back...The other is our banker will write a statement on letterhead as well. He became friends with my hubby :)

Point of clarification: such affidavits are optional, they are not a "must".

Yodrak, the I-130 changed recently to include these. I quote:

NOTE: In addition to the required documentation listed in 1) through 4) above, you should submit one or more of the

following types of documentation that may evidence that bona fides of your marriage:

1) Documentation showing joint ownership or property; or

2) A lease showing joint tenancy of a common residence; or

3) Documentation showing co-mingling of financial resources; or

4) Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or

5) Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or

6) Any other relevant documentation to establish that there is an ongoing marital union.

Although the wording is loose, it certainly implies that you should send these if you can. This language was not present on the previous I-130 which only asked for affidavits if you didn't have a marriage certificate.

They're not a requirement if you can submit the other documentation that USCIS requests. However I would personally recommend people to submit them. I'm sure USCIS added this requirement for extra evidence to the I-130 for a reason (it certainly wasn't there when I submitted a I-130 before).
