Need help with AP document

Hi Everyone,

I applied for AOS May 1 and I didn't apply for AP at that time. I went for an Infopass appointment this morning and was told that I am stuck in background checks (booooo!). So...before the fees go up I am applying for AP. I have a few questions about the application form because the guides on VJ don't clearly address it, and I am confused! I hope someone can help :)

1. I don't have a date of intended departure or expected length of trip. Can I just put TBD in those two fields?

2. Since I am applying for AP, do I leave from Part 3 section 4 all the way to Part 7 BLANK? It seems like a lot to be left blank!

3. It asks in Part 7 to explain how I qualify for AP. How does someone with AOS pending qualify? Also, I was just going to put down that I would like to visit my family at Thanksgiving and Christmas, and my huband and I would like to go on a Honeymoon. Is that considered the appropriate circumstances to warrant a multiple-trip AP? The instructions are sooo vague!!

4. Do I leave Part 7 sections 2 and 3 blank?

As for supporting evidence, this is what I was going to send. Please let me know if I have forgotten anything:

- Copy of Biographic Page of passport

- Copy of K1 Visa

- Copy of front & back of I-94

- Copy of marriage certificate

- Copy of NOA from AOS

- 2 passport style photographs

- $170 fee

One more thing- has anyone ever had trouble getting back into the U.S. when using AP? I am pretty nervous about it!!

Background checks? That sucks. :(

2. What do the directions on the form say?

3. Yes, you qualify for AP because you are pending adjustment of status.

4. Yes, or better yet write in that the applicant is in the USA.

Jashley,

One issue would be if a person has more than 180 days out of status on their record. AP does not trump a ban due to out of status time.

Another issue would be if someone has done something while they're away that makes them inadmissable.
