TN Visa

Hello folks,  I am a Canadian Citizen and my son lives in Michigan. He has a green card and he is married to US Citizen. I want to move to the USA with my family.  Can he sponsor me to enter and work in the USA?. There are several jobs which are perfectly matched with my experience however I cannot get them because of the visa issues.

You son can petition for you and his mom when he becomes a US citizen, as category IR-5.  He can only petition his parents.  Actually, he can also petition his brothers and sisters but that takes 14+ years (category F4).

 

 

Your post title is TN visa.  That has nothing related to family visas.  For that, you would need a US employer who needs to employ a NAFTA professional.  Also, TN visa is a non-immigration visa.

If USCIS approves Form I-129, you, the prospective worker, may then apply to CBP for admission to the United States as a TN nonimmigrant by providing the following documentation to a CBP Officer at certain CBP-designated U.S. ports of entry or at a designated pre-clearance/pre-flight inspection station:

• Proof of Canadian citizenship; and 
• Approval Notice from USCIS for Form I-129.

In addition, when applying for admission, you should have in your possession a copy of the Form I-129, and all supporting documentation that was submitted to USCIS, to respond to questions about your eligibility.  You should also be prepared to pay any applicable inspection fees at the time you seek admission.  If a CBP officer finds you eligible for admission, you will be admitted as a TN nonimmigrant.

I am more interested to get TN Visa to enter and work in USA. I know my son will file a petition when he will be a citizen.  I requested your expert opinion to get a TN Visa.

Assuming you qualify then a TN visa seems pretty simple

A TN work visa is temporary and is only available if you have:

 

1.  Professional qualifications required for a TN:  "Among the types of professionals who are eligible to seek admission as TN nonimmigrants are accountants, engineers, lawyers, pharmacists, scientists, and teachers."

 

2.  If you fall into one of the above professional categories, then you will need a written job offer from a US employer:

 

Proof of Canadian citizenship;
Letter from your prospective employer detailing items such as the professional capacity in which you will work in the United States, the purpose of your employment, your length of stay, and your educational qualifications; and Credentials evaluation (if applicable), together with any applicable fees.

 

Canadian citizens can apply for a TN visa at a US port of entry with the above documentation.  It will be up to the officer to decide whether you qualify, and if so, how long you can stay in the US.
