I-864 Mumbai Consulate Joint Sponsor advice

Good morning guys,

 

                          After some discussion here, due to my income levels, I decided to get a Joint Sponsor for my spouse in India (IR1 visa). Remember in Mumbai consulate, they always want to see your 3 tax year return (unlike other consulates where 1 year transcript it enough). Luckily for me my best friend (a US citizen) said he will sponsor me. Now he has two kids and a wife, so if he has to sponsor my wife, he should be making $38,800 (for 5 people,1.25 times the Federal Poverty Line) for the past 3 years.

 

Unfortunately, he made only $41200, $34500and $36200 over the last three years (2018,2019,2020). Now I read somewhere if your income does not match the Federal poverty line, we can show cash or assets, but it should be five times the difference.  So for 2020 it should be ((38800-36200)*5=$13,000). He has around $20,000 in cash, lying around in his checking account. This account is only 1 year old. He is ready to provide the last three months bank reports as a proof. But would this be enough at the Mumbai consulate, since they want to make sure the numbers look good for the past three years?

 

Another option is his house. His house costs around $270,000 and he already paid around $120,000 in mortgages. He is willing to show this as a proof too, but I am not sure how will it cover the past three years conundrum?

Any advice would be really great, thanks!

Looks marginal.  Note that Mumbai does not just want to see 3 tax returns.  Tax returns are about the past, yes, but Mumbai wants to see three past years of QUALIFYING income.  Equity in a primary residence will not help.  Please read the instruction section that discusses "liquid assets".  Equity in a primary home or only car is not considered liquid because liquidating it would harm the sponsor and their family.

It's marginal.  Consular Officers KNOW your joint sponsor is not going to sell his house and/or use their surplus cash to support your spouse.  This is a judgment call to determine how likely it is the immigrant will become a public charge.

If it was a math problem, everything checks out and no problem, pass.

 

However, they look at the totality of the condition. A person with own household of 4, earning less than poverty guidelines for last two years for size of 5 and with only 20k in bank. Very likely they could ask you find another. 
 

Try to find another with better income. In case you can't find any, go with this one with all solid evidences of assets and finger crossed. Showing 3 moths of bank statements makes it look line money was added just for this i864, be careful on that.
