Hello,

My parents have had a B1/B2 visa since the 1990s and they have traveled to the US many times. They reside in Ecuador but mom is Colombian and dad is Argentinian. I got married 10 years ago to a US citizen and was naturalized in 2016 and have been living in the USA since 2008 (started living here as a F1 student). I would like to apply for permanent residency for my parents. I have a couple questions.

Should I apply while my parents are here on their B1/B2 visas or wait until they are back in Ecuador?

         -If I apply while they are here on their tourist visas will this application require an I- 485 and would they be able to leave the US while they wait?

If I apply while they are in Ecuador do I still need to file an I-485 AOS or just an I-130?

If I apply while they are in Ecuador will they still be able to travel back and forth on their B1/B2 visas?

If I apply while they are in Ecuador will it take longer than if I apply while they are here on their B1/B2 visas?

 

Any advice would be appreciated.

IIf they are currently in the US and do not need to travel or work for some time you can apply for them to adjust.

 

If they are not then just file away with the I 130. Many people visit whilst the process is underway.

Depends, if they are here right now, you can file the I485 along with the I131 and they will be able to travel once they receive the AP card.  If they are not currently in the US, then they cannot enter with the intent to stay and adjust status, so the I485 is out-of-the-question, but you can still file the I130 and they can still travel back-and-forth with their B2s.

Just the I130.

See first question response.  The overall processing time (I130 and consular processing) is usually around 1-2 years for an Immediate Relative visa.

They are onboard with permanently relocating the US. They are ready to be close to their grandkids :)

 

In the I-130, as far as an address of where they intend to live, can I put my address for now? They are planning on buying a house but obviously wont until the visa is approved.

Yeah, put your address at this point.  We filed an I130 for my adult stepson and we used our address for that filing.

@angelviolepoj You can use your address first and do a change of address much later after their house purchase. If it isn't an all-cash purchase, you probably will have to be the one taking out a mortgage as they won't have any US credit history or SSN.

 

Given their age, I'm assuming there's no rush for them to work (EAD) or travel overseas (AP card). If you have a good reason you can always attempt an expedite for either the EAD or AP card. If successful, an approved expedite of either will result in both being issued as EAD/ AP is issued as a combo card not separately.

 

Also since you are doing a concurrent I-130/ I-485/ I-1765/ I-131 filing, you cannot do it online (online is for I-130 only).
