Hello! My story or question is following.  I met my long distance boyfriend online a year ago. After 2-3 months of our online communications we decided that we want meet. He is from USA and I am from Ukraine. First he thought that he will be able to come visit me, which would be perfect, but then his own personal reasons didn't allow us to meet. Nothing criminal and I know for 1000% he is not scamer or lying to me or have double life. So i decided to make visitor b2 visa as he invited me to visit him. I applied for visa in Ukrainian embassy, but because of  covid my visa appointment was canceled twice already.  I called to the embassy and they told me we can also apply k1 visa at the same time.  On some forums people advise not to tell that i have boyfriend in USA, but at the same time i have strong reasons to come back home after visit and now I'm looking for an options how to make our meeting, should i wait just for another appointment,  should I apply in another country to the embassy or should we start make k1 visa, but will it be possible without even one meeting. I would appreciate any advice

No, since it's required: https://www.uscis.gov/sites/default/files/document/forms/i-129finstr.pdf "Submit evidence that you and your fiancé(e) met in person during the 2-year period immediately before you filed this petition."

K-1 is for engaged couples.

 

You have never met in person.

 

You do not qualify.

If it's just travel to Ukraine that he can't manage, then how about traveling to a third country that you can both enter?

You must answer truthfully, but no need to volunteer information that is not asked.  If any US immigration officer asks directly if you have a boyfriend in the US, tell the truth.

You must be honest in order to avoid strict misrepresentation bar.

And if to prove that he has hardship to visit me or 3rd country at this moment it may help. And maybe right some letters from both sides that we have serious sincere intentions.

You must answer truthfully, but no need to volunteer information that is not asked.  If any US immigration officer asks directly if you have a boyfriend in the US, tell the truth.

 

I can travel in 3rd country but he can't for now(( maybe I can apply for same b2 visa in other country if i can get interview date earlier there?

For K1 application, unless your fiance is bedridden, it would be next to impossible to be exempted from the 2-year meeting requirement.  If you do manage to meet in person, a statement of your intention to marry is actually a requirement to be able to start the K1 process.

 

For B2 application, unless a US citizen relative has a life-or-death medical condition, the US consulate would not care about the USC's hardship when deciding whether to grant a tourist visa to the foreigner.  They also won't care about letters with your or the USC's intentions.  What will matter most to the US consulate will be evidence of your ties to your home country, as documented in your DS-160 application form.

If you can find a US consulate that will accept a B2 application from a non-resident third-country national, sure.  But such consulates usually warn applicants that they would have lower chances of being approved for a tourist visa as it will be harder for the consulate to assess their ties to their home country.

Is it better just to wait for another b2 visa interview or looking for opportunity to meet in the 3rd country?

I think you are correct.  By law, the OP will be presumed to have immigrant intent....and a BF in the US could easily strengthen that suspicion.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I would not advise you to lie to US immigration.  We have seen numerous people lie on their B2 visa application......then later end up in a situation which they cannot correct.  Just be completely honest an all visa paperwork.  Perhaps the 3rd country option is the best possibility.  Good luck.
