Converting F2A to IR2

Timeline

If a case is already documentarily qualified as F2A at the NVC, how would it be converted to an IR2 if the petitioner becomes naturalized? Would doing this put you in the back of the line for IR2 cases?

I-130 submitted: 03/05/2020

I-130 NOA1: 03/10/2020

I-I30 NOA2: 02/03/2021

DQ at NVC: 06/24/2021

The petitioner should contact NVC to convert the case.  Yes, it is possible that the case is placed at the back of other IR cases.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It's my wife. She is not naturalized yet, but we submitted N400 last week. Yes, far from 21.

My wife is the petitioner as an LPR. She petitioned her two children who live in the Philippines.

They could have been petitioned by you as your stepchildren when you petitioned your wife.  That is, if you are a USC.  If you were a LPR when you petitioned your wife, then your stepchildren could have come as derivatives of your wife.

 

Anyway, it seems too late for the above. As @crazycat stated, yes, your stepchildren's category can switch by contacting NVC when your wife becomes a citizen.  But for now, they are still F2A while the N400 is under process.  It will remain F2A until she gets approved and takes the oath.  That may be a year or more from now.

Would that put the case in the back of the line for IR2? I have no idea when the F2A interview will happen.

I thought you don’t have to do that. The NVC can upgrade the status.

Oh...OK...I guess I misunderstood the situation.....Sorry.  I thought the children were derivatives.......

If they are DQ'd already, then the odds are very good that they will get an interview before your wife becomes a citizen.  I wouldn't worry about this now.   Wait until at least her N400 interview is scheduled.  If you sent the N400 last week, then that will be sometime in late 2022 or 2023.

The DQ date is June 2021. I’m not sure.... COVID doesn’t appear to be leaving anytime soon. It would be nice, though.
