Just some questions (I864)

Hi everyone, my wife and I filed i130 in July of this year and we initially wanted to just do consular processing, but an emergency happened and we decided to adjust status while she is here visiting the states, she’s on ESTA at the moment. We are trying to file the AOS so I have a few questions, 

1) Would this application be considered as concurrently filed? Seeing as we filed i130 months ago. 
2) I could not file my taxes in 2019 because someone made a mistake with my ssn and applied me as a dependent and so I was barred from filing taxes, tried to rectify the situation but could even see who filed me as a dependent. I have filed taxes diligently the other years tho, should this be a problem?

1. Not exactly concurrent. Does it matter though? Just file AOS.

 

2. It may affect, try to gather whatever info you are having with IRS to resolve it. It's Nov of 2021? Still not resolved?

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

2016-05-16: N-400 NOA1

2016-05-26: Biometrics

Does that mean we have to reapply for the i130 in order for it to be concurrently filed? And yes it is still not resolved, I have documentation to show that I have tried to find out who filed me as a dependent, but not even the IRS wanted to disclose that information. Went to other parties too and same result.

1.  Submit the I-797 receipt  for the I-130 along with the I-485 package.

2.  I don't think your situation prevented you from filing your own taxes.  I suggest you rectify the situation with the IRS asap. As a sponsor of a new immigrant, you MUST be current for the last 3 years....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
