Good Day everyone,

My wife and I would like to expedite our I-130 petition for Medical and Financial Loss reasons. My wife was fired from her two jobs due to her inability to do her job due to arising medical problems. She's also diabetic and because of that she lost her right foot. Her medical bills are piling up due to surgeries and admissions at the hospital and more surgeries on the way. No company will hire her with her present condition. She is also fighting series of infections on her foot and had to go through Home IV antibiotics and she's right now fighting new infections which could make her lose her remaining foot. What evidence could we submit to back up our claim for financial loss and medical condition

Provide  evidences of what you listed about her conditions  and mention why you need to be with ber soon to request the expedite. I am guessing you a joint sponsor is there for you.

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

First companies can be sued for firing someone with a medical condition like u describe and your wife needs to see a lawyer

the company should have put her on short term disability while she applied for SS benefits

she needs to see a lawyer for all this 

 

next,  u just applied November 2nd 2021 

even with the correct documents it will take time for expediate to go thru

and that does not insure a visa will be approved especially with only the visit in October to consumate online utah marriage at the Lagos embassy

the CO is going to question you fully about things that seem strange

like the following

like how can she afford to travel with all her bills 

who helps her now

can you work to provide for her and also do the home care she needs'

how can she afford this visa process

We r just looking to see if we could expedite the process based of off her medical. She would visit again before the interview and would visit for the interview

You've done K1 before, but now you're pursuing spouse visa?  Who is the beneficiary -- you or your wife?

He’s the beneficiary from Nigeria. USC is the wife.

It sounds like your wife has grounds to expedite, but that doesn't mean your case will be complete soon.  It appears you started the spousal visa process about 3 weeks ago.  USCIS can expedite, but the petition will still have to go through NVC.  That part of the process will also have to expedited at the discretion of the consulate in Lagos. Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

As others have said, looks like the petitioner has a strong case to expedite so go ahead and do it. Though, you'll need to expedite at all 3 different stages separately, meaning you'll need to expedite 3 times. One at USCIS, one at NVC, and one at USEM. Good luck.
