Hello Group,

My stepchild lives with us and I have not adopted legally, What would be the best document to attach in this section ?

image.png.9b4cee23b45e411ae41e29dea5c761ae.png

You mentioned that you have not legally adopted the child, therefore I am assuming that there would only be a birth certificate naming the child’s biological parent or parents and not a court order or adoption certificate naming you.

Birth certificate is the only item from tha list for you. How old is the child? If under 18c you can't file N400.

Thank You, Yes I think that would be the only document that I can upload, I'm planning to add a supporting letter to detail out.

I'm applying for my N400 and there is one section which asks about any Stepchildren that I have, so when I add the step child information there the system is asking me to upload this document. I believe this document upload section is dynamically determined based on the answers I filled in

Correct me if I am wrong, but if you have not legally adopted the child, he is legally not your child Unless you're married to Mom and she is the legal guardian.) What is the child's status? Who is the guardian "on paper?"

Nope. Stepchildren are considered your children for immigration.

N400 is the only form tat specificially mentions "stepchildren" in their instructions on page 9:

"Indicate your total number of children. Count all of your children, regardless of whether they are alive, missing, deceased; born in other countries or in the United States; under 18 years of age or over 18 years of age; married or unmarried; living with you or elsewhere; current stepchildren; legally adopted children; or children born when you were not married"

You're very welcome. I know it's sort of confusing because nowhere in the i485 or i751 forms does it talk about stepchildren. Only the N400 form does. To make things more confusing, you know? Lol
