31 Years ago, I was pregnant and I got into a fight outside a bar. I tripped an officer who was chasing my sister. While pregnant with my daughter, I was giving probation. I am now working as a nurse and I want to bring my granddaughter to Disney Orlando. I applied for an esta but was told I cant travel. I looked up online and it says I need to get a police cert, a ds160 and go to the consulate. Can anyone advise me on what I can do? I dont know where to begin. I was arrested 31 years ago and got probation, now Im a grandmother and a nurse, what is the process to get a visa

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

ESTA is telling you to apply for a visitor's visa due to having a criminal history.  If you put your country's flag on your profile, someone from your country can tell you where to go online to apply.

First, someone already asked about your country and you did not reply -- without that, nobody can give you specific information about how to proceed, since procedures on how to get the proper police certificate, set an interview appointment, etc., are Embassy specific.

Second, you need to be careful not to apply your country's legal concepts, laws, and procedures to US visa/immigration law.  US immigration law very specificly requires you to include ANY arrest and/or conviction, whether it was subsequently spent, expunged, pardoned, or benefited from some other legal action.  Not sure what you are referring to as the "spent act bill" -- that is not a term used in US immigration law.  If you are referring to the part of the law that applies to a person who has a single conviction for a crime of moral turpitude, there is an exception to the ineligibility to enter the US if the conviction meets certain requirements.  Whether your offense/conviction meets those requirements will be evaluated by the consular officer during the interview.  It is not a provision of the law that you can use ahead of time that says you don't have to reveal your conviction at all.

The profile says Ireland.

Thanks for this.  (I don't usually look at the profile when responding -- obviously!)

OP -- all the information you need is at:   https://ie.usembassy.gov/visas/nonimmigrant-visas/

(This is the same link Crazy Cat responded with earlier).

Click on the "Nonimmigrant Visa Categories" and then click on "Tourism and Visitor".  That has the info on where and how to apply.  Under the "Required Documents" tab there is a bullet point for those who have had arrests and convictions, with a link to the information on getting the proper police certificate.

If in the Republic of Ireland you can get a police cert from your local Garda Superintendent, have a look at the link below. I had to get a cert for immigration purposes and I filled out the form and posted it to the Local Station addressed to the Superintendent. It took 2 weeks to get mine back.

https://www.garda.ie/en/about-us/online-services/data-protection-foi-police-certificates/police-certificates.html

Quote

A Police Certificate is a certificate in respect of an individual issued by the Gardaí in certain circumstances.  The certificate, which is valid for 12 months, states your name, address, date of birth and also includes information about whether or not you have a criminal record in respect of this jurisdiction.

A Police Certificate is issued by the Superintendent and/or Assistant Principal Officer within the Division where the relevant applicant resides, or formerly resided, in the Republic of Ireland. Please go to our Station Directory to find out who your District Superintendent is.

Police Certificates are issued solely for the following purposes:

    1. Foreign Consular Authorities
    2. Foreign Visas
    3. Establishing a Business in another EU State

The following documents are required:

• Completed application form
• A certified copy of your passport, driving licence or similar for identification purposes
• Proof of address and / or proof of previous addresses

The Police Certificate is issued free of charge and will take approximately three weeks to process.

thank you. that is so helpful in advising me of how to apply for a visa. Thumps up from this grandmother

Really?

Anyway, you mentioned more than once in your post that you’re a grandma nurse, so I assumed you thought it was important.   It isn’t.
