Hi there!

After ariving in the States with a K1 visa can I apply for a SSN for my daughter also (she's coming with me, on a K2), along with mine? She is 3 years old. I figure she will need that, right?

I understand that most likely she will not get an A# at the airport either, but only in the AOS process.

February 6th 2007 - K1 petition sent to TSC

Bianca,

A K2 needs to obtain employment authorization in order to qualify for a SSN. A 3 year old should require neither.

When the next tax season comes, if she is not yet an LPR - which qualifies her for an SSN - get her an ITIN. The ITIN can be given when an SSN is asked for.

Until one or the other is obtained, when asked for a SSN, simply say that she does not have one because she does not yet qualify for one.

I may speculate from there in two directions, you see, that's why I asked the question.

On the SSA site I could not find more info regarding this specific situation; they are only talking about SSN for USC children, which is not the case here. On the other hand, if I read between the lines, I tend to agree on two distinct things with both of you :D :

1) With Yodrak, that it seems I will not really need a SSN for my daugther at this moment (I thought I might need it to register her at kindergarten, which we plan on doing asap, so that she will learn English faster);

2) With YuandDan, that I do not need a GC or and EAD for her in order to get her a SSN, but whatever the conditions I need for myself they will apply for her as well, meaning that if I qualify for a SSN (which I will), then she does as well.

PS Yodrak... now you made me wonder about a new thing, the ITIN :D Don't worry, I figured it out already, I'll dig in more about that also. It's a never ending story when you change your country...

Valid EAD for a child under 12? It wouldn't make sense, would it? For the parent of the applicant child, yes.

Green card is also valid EAD.... so in that sense it does make sense.. if you are only thinking about the I-765 for the 1 year EAD then it would not.

Recognize that the SSA assigns numbers and issues cards for its' own purposes only - specifically for setting up a person's federal benefit accounts funded by payroll taxes. Given that the USA lacks a national ID system, and virtually all US citizens have a SSN, other entities of all types have adopted the SSN as a defacto national ID number for their own convenience, even though they have no right to do so and the SSA has no obligation to support them in doing so. (The IRS is almost alone in recognizing this, by issuing an ITIN to people who do not qualify for a SSN.)

So yes - anyone who wants a SSN needs to have a legitimate reason for getting one, and the only legitimate reason is those payroll taxes, i.e. employment.

Valid EAD for a child under 12? It wouldn't make sense, would it? For the parent of the applicant child, yes.

A K-2 cannot obtain a SSN until they have their GC. After the child obtains the GC, then a SSN can be issued.

A parent can apply for the child's SSN (for a child under 12), without the child being present. If the child is older than 12 years old, then the child must appear in person to apply.

Ok, thanks for the replies, I will see more about it when I get there and let you know how we settled this issue. We have found a nice kindergarten already and they said all I need to register her is the passport so... that's a first good sign. :thumbs:
