Some here have tried, with no real evidence of it affecting the I-130.  

 

It's just another form that USCIS will have to process and administratively close out, adding to their workload.

It worked for me! 

Found love, thought I wanted this path, two years later realized my partner was not worth all the stress 😁

The NOA1 for the I130 is a required attachment unless you file the I130/I129F together.

NOA1 = Receipt notice.

 

Note that back in the day when a K3 visa was an actual option (My Ex got one.) it was best to file the forms together.  However, NOW, since you are only trying to speed up the process for approval of the I-130, you want the later filed I-129F to be a trigger instead of being immediately closed upon concurrent receipt.  No guarantees, but sometimes it works.

I feel silly that I don't know this after all my research, but I keep hearing different things so I'm very unsure. I heard that Canadians cannot file the K3 but I'm not quite sure if that means I can't file the I-129F to try to act as a trigger for my I-130. 

 

Also, IF I am able to file the I-129F to go alongside my I-130, do I have to pay the $535 fee as with that one as well?

 

Sorry for these questions but I just keep hearing different things and I don't know which to listen to.

Anyone can file the I-129F (K3). And there is no filing fee.

The reason why you hear different things because everyone has a different experience.

Some people file a K3 right after their I-130 and get approved in 100 days.

Others file a K3 after a few months and the I-130 is approved after 30-60 days.

For others? Nothing happens. 

 

Read around the K3 forum and you'll see a multitude of experiences. But, be aware by filing a K3 you're giving USCIS another paper to process and adding to the workload.

Thank you! Yeah, I almost feel bad adding to the workload, but at the same time, I would love for it to MAYBE speed up my case. I think we all want a fast moving case, you know? We filed just over a month ago and it's still in "Receipt" mode.

We were in "receipt" mode for 5 months. There really is nothing to do but wait 😅

Luckily you are from Canada so visiting your partner is easier and cheaper.

Totally!! It's definitely easier and cheaper than a lot of people. I am very blessed for that. I'm not expecting any sort of fast movement to be honest. I just WANT fast movement haha. Should I be waiting until it changes to the next step to file I-129f? SO sorry for all the questions.

You need to make your own decision.

No one can tell you what will happen. But, if you decide to file follow up so others can hear another experience.
