I received a RFE for the I865 Affidavit of Support, although they said I need to properly document my household size but they also said in the letter that I don't meet the income requirements of 125% poverty level and that I need a joint sponsor. I am a little confused about that. I am a nurse and earn $67,000 per year and it's just me and my husband in our household, why does that not meet the income? My question does my income meet the 125% poverty level requirements? And should I just resubmit the form with the evidences requested or find a joint sponsor? Please advise.

Post a screenshot of your household size calculation page. It's likely filled it out wrong.

Also how did you prove your income?

What documents did you provide?

They likely aren't the correct ones or are incomplete documents.

Sorry I meant the I864 Affidavit of Support not I865. I have attached a copy of the letter below. I don't have the exact form I 864 I filled but I entered 1 for questions 3 and 2 for household size. Like I said my income is $67,000 and it's just me and my husband in our house hold. Please advise me on what I am doing wrong.

I sent letter of employment verification, 6 months paystubs, 3 years tax transcripts, and bank statement. My household size I entered 2 for that. Please let me know what I did wrong.

Your household size says 1 in the screenshot.

#1 is "1" for the applicant.

#2 is "1" for the sponsor.

#3 is blank.

#4, 5, 6 and 7 are "0".

#1 plus #2 will auto populate #8 to be "2". Yours doesn't say that.

What amount did you enter in part 6 question 7?

If you submitted all of those documents that question would have to be your predicted 2021 income from your Employment Verification Letter.

If you entered any other amount there from your taxes for example, it wouldn't be accepted 

Why did you submit a bank statement?

If your income met the poverty guidelines, assets are not needed or helpful because if you submit the wrong type of bank document it won't be accepted either.

Did you submit a statement from the bank as described in the I134 website dropdown menu or did you submit a monthly bank statement? (That's not what it's asking for).

 

Wrong amounts/wrong documents = rejection.

I’m following this cause I also got an RFE with the same reasons. However, my husband is currently unemployed and we are not sure what documents we can present since he doesn’t have w2s, IRS and other tax documentation. We have his dad as a joint sponsor but he is retired. He has assets and all that. With regards to bank statements, what should be ask the bank? Cause they only gave use the list of transactions per month.

You might have counted your spouse twice.

For 1. (persons you are sponsoring) you should write 1 (your spouse)

for 3. If you are currently married enter "1" for your you should not write 1. because:

NOTE: Do not count any member of your household more than once. 

 

Because you counted your spouse twice it looks like you have a household of 3.

Try using an updated version of Adobe Acrobat Reader.
