Marriage based greencard

Hi guys 
So i’ve been married to a us citizen wife for 3 years since 2018 and i have a conditional green card now which is getting expire next year . So we were in love and bonafide marriage from last 3 years but I didn’t know that she was cheating on me i just figured out now when she gava a birth to a child which is not mine it’s from someone else i always thought it was mine but I didn’t know she was cheating on me . So im so scared now and i have no idea what to do now to remove the conditions on my 2 year green card i feel like if we give that reason to uscis they will think this was not a bona fide marriage if she was cheating on me . Im getting divorced soon . What should i do?

Not much you can do. If you get divorced before you are eligible to file for Removal of Conditions you just self file sending your divorce decree in. No big thing. Sending evidence of your life together to show you married in good faith.
People file everyday divorced and have no issues.

You gather evidence of the bona fide of your relationship, even if you divorce. Start collecting evidence now if you haven’t been doing so. Then, file for divorce if this is what you want. You write a letter to USCIS asking them to switch your case to a divorce waiver, and then send the divorce decree when they request it.

USCIS doesn’t really care about why you divorced. People divorce all the time. In fact, you can just state that you divorced because of different personality types, which is not a lie. Don’t offer details unless they ask you, but don’t lie either. Just because you divorce they will not think it’s not a bona fide relationship.

Sorry for your situation. 

If you do not want to remain married to your spouse you can file a i751 devorce waiver application when you are ready. You will need a final devorce decree so you will want to file for devorce soon so you can file your i751 waiver case. 

 

I751 devorce waiver applications to remove the conditions on your green card are routinely  approved with adequate evidence of a bona fide marriage, that is a marriage entered in good faith. 

 

Collect and save evidence of your bonafide marriage to include with your i751 waiver application; joint tax returns, joint bank statements, joint bill, photos together, copies of IDs with common address, joint lease, joint insurance, copy of mail sent to joint address, W2 and 1099s sent to home addresses, any other document mailed to your home.

 

You can file your i751 devorce waiver case any time you are ready, the normal 90 day joint i751 application filing window before the expiration date on the green card requirements do not apply to i751 waiver applications. I751 waiver application can not be filed too early or too late (best to file close to expiration date).

 

So collect and save your evidence of your bonafide marriage, file for devorce get your final devorce decree and then file your i751 waiver application even it is before your conditional green card expires.

Sorry for misreading your post, you will need to file for devoce id you want one and then convert your current i751 application to a device waiver case.
