Establish domicile in us

Hi ! My mother who is a LPR filed an application for me(f22) and i recently had my visa interview but they gave me a 221g asking for additional documents related to establishing domicile, since my mom lives here in our home country temporarily and she’s waiting for me to get my visa so we can live in the us once and for all. I’d like to know what are the documents that we can send to the consulate to prove that she does intend to live in the USA and that she only stays in her home country for a reason !

Utilities

Bank accounts

 

Perhaps she needs to re-locate back to the US first, secure documents proving she actually lives in the US, and then you follow later.

If your mother is living temporarily abroad as an LPR, I assume she has a physical address in the US, so things like mortgage/lease, US based bills, etc. will help.

How long has she been outside of the USA as an LPR?  Did she have an approved I-131?  

 

If it hasn't been so long, I'd agree with Crazy Cat.  But if she's been gone too long, there may be other complications.

The thing is she keeps going back and forth to the us ! She stays in her home country for 6 months and goes back to us n stays one month or two so basically she spends more time outside of the us

Bingo........She might have to move back, then obtain some solid documentable proof of domicile.

In my opinion Mom needs to be moving back now and showing she is truly a US resident not a visitor. Here's some other ideas but she needs to get back to US.

Please note, if the petitioner lives with the beneficiary abroad, you'll need to provide proof of US domicile with the AOS package, as well as bring it with you to the interview. Please read the I-864 instructions (pages 3 and 4) for information about it. This is NOT needed if the petitioner is living in the US. Here is a sample cover letter to include in the package (it lists MANY possible documents, some may not be applicable, of course, to prove that you have, or will re-establish, domicile in the US):

• Contacted my auto insurance company to find out about re-instating my insurance on my car

• Contacted shipping company for estimate of costs to ship belongings

Supporting documents for the above steps I have taken:

• Lease agreement for our house

• Email from schools regarding registration requirements

• Email from my former auto insurance company regarding my inquiry

• Email from XXXX with estimate and correspondence regarding shipping our belongings

I declare that I intend in good faith to re-establish my domicile in the United States no later than the date of spouse's admission into the US.

 

I certify under penalty of perjury under the laws of the United States that the statements in this letter and all accompanying evidence are true and correct.

My guess is that the Mother may never have established a US domicile, somewhat different to a USC who may have moved abroad for a while.

Thank you ! Is it okay if she gets back and gets her drivers license now along with other new docs and use them as an additional proof or it will not count since it was done after we’ve been asked to send the documents ! 

She maintained a bank account ...bills etc
