Hi there ,

 

My brother in-law have had his interview at the us consulate in Casablanca on 11/7/2021  For f2a visa category everything was excellent but he his visa was refused under 221 (g) for administrative processing  . one thing they asked him was how did your wife went to USA and he said through dv lottery 2018 .the officer goes why you didn't go with her . he Said i was under administrative processing and they granted my wife and my son a visa and after sept 30th is was still under admin processing . the officer was shocked and then she goes when the last time you didn't see your wife he goes October 2018    .then they issued him this form bellow for further investigation  .  it's very painful guys . i don't know how I'm going to help him out . any idea , advice , will be greatly appreciated .

everything is completed nothing is missing .

Yeah, unfortunately not having seen each other for three years definitely calls the bona fides of the marriage into question.

 

It was not smart to not visit during that time.

there's no way to help him out

he will have to wait for the CO to make a decision

Most of us would like to see the English side of this form as Arabic is not our language

 

first of all He just interviewed for F2a in 11/21 and she came of dv lottery in 2018?

why didn't he interview back in 2018?

when did they marry?

why hasn't she returned to see him?

does he support his child in any way?

he didn’t interview because he was under administrative processing under trump administration! My sister and her son were cleared from AP but He wasn’t knowing that DV system doesn’t extend after fiscal year September 30th .

they got Married back in 2014 .

she didn’t go back to see him for Covid circumstances and her son was going to school . 
 
he’s overseas so he doesn’t support him except sending gift and stuff .

Sounds like he did not get his visa so she and the child went solo and then she petitioned him as a LPR

I think petitioning him was the right step as the fiscal year had already ended. 

Only problem is visiting but COVID played a role too. Though she could have tried. I still understand why she didn't. 

My best bet is he'll get the visa this time. They're are just some people who are super unlucky. I think he falls into that. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

sorry,  hope he doesn't use that as excuse 

no covid in 2018 and 2019 and begining of 2010,  we traveled to Europe

and school is out 3 months a year plus fall and spring breaks of 2 weeks each

yes,  it is costly but Casa expects us to spend quality time with a spouse 

sorry that all sounds rough,   just looking at what a CO would question

 

so,  he did interview in 2018 with her and has been in AP all this time

and this would be a new interview?

Yes this a new petition new everything! 
Dv lottery only last until September 30th and that’s it 

 

we submitted I-130 so this interview was not related to his old dv lottery AP

Covid didn’t prevent them from having visits during 2018 or 2019 though.
