Hello folks, 

 

I've seen quite a lot of people say that they've included 2 affidavits with their I751 application. What are those? Have not seen any requirement on USCIS website.

11/12/2021 - Documents received by USCIS

11/15/2021 - Text message informing of receipt notice being sent in mail

11/16/2021 - Bank account charged for I-751 form and biometrics

05/04/2019 - AOS/EAD/AP application delivered

07/22/2019 - An email from USCIS requesting additional information

07/23/2019 - Requested documents sent back to USCIS via fax (took an hour to go through) 

07/26/2019 - Escalated an expedite request to USCIS Tier 2 (no e-mail confirming receipt of docs);

                         Service request submitted by Tier 2 to NBC; response to be received by 08/10/2019

08/01/2019 - E-mail from NBC confirming that my "application has been approved and submitted for processing"

08/02/2019 - Case status changed on EAD to "New Card is Being Produced"

08/03/2019 - Case status changed on AP and EAD to "Case Was Approved"

08/05/2019 - I-797 NOA received in mail ("We have approved you application for an Advance Parole Document")

08/05/2019 - Case status changed on EAD to "Card Was Mailed to Me"

08/06/2019 - Case status changed on EAD to "Card Was Picked Up By The United States Postal Service" (CaseTracker); tracking number provided

Affidavits are NOT required, and they are considered secondary or tertiary evidence.  They are most helpful when there is a very unusual situation - for example - when there is a major difference in culture or religion (think Muslim/Christian), or where a couple has not been able to live together since they've been married (think one partner works and the other attends school full-time in another location), or where a couple does not have a formal lease because they live with friends or family.  If you have good evidence of living together and combining your financial lives, you will not need affidavits.  If your evidence is NOT so solid, then VERY SPECIFIC affidavits are helpful.

Affidavits are listed in the USCIS instructions as evidence accepted that you and your spouse are in a bona fide marital relationship and that you are married. The affidavits are statements from family, friends, landlord... that attest that you and your spouse are married, and you live together as spouses during your marriage.

 

They are not strong evidence they can be useful in filling in the gaps of evidence. If you live with family, for example an affidavit from the inlaws indicating you and your spouse live at their home as a married couple would be very helpful in that case.

 

Stronger evidence, birth records of children together, joint lease, joint tax transcripts from IRS, joint bank statements showing joint spending and savings, joint bills, state ID with common address and so on

Case move to National Benefits Center December 2020 for quicker processing from California Service Center

Oct 2021 out of processing time inquiry made, response May 5th 2022 that our i751 case will be addressed at our n400 interview
