Report of marriage with Online marriage cert re-marry in PH?

Hi,

 

I am planning on sending my 9A visa application next week and I know the consulate in Toronto wants ROM (report of marriage) as my friend just went through the same process.

 

Our question is that if we apply for ROM and obtain the 9A visa while ROM is processing can we marry again in Philippines and will we be issued a new Marriage Certificate that states we married there.

Someone told us that we would be re-issued the same Apostille that we originally used (from Utah, County) to apply for the ROM in San Francisco which defeats the purpose of why I plan on traveling there.

 

Can someone clear this up?

Can you clarify what purpose you mean?  What's wrong with the marriage certificate issued by Utah county?  Does Canada not recognize marriages performed under US law?

Who is that "someone" who told you that info? You're already married, and with the ROM, you're going soon going to have a record of that marriage certificate in the Philippine civil registry records (PSA). So you don't need to get married again in the Philippines just to generate a marriage certificate.


You can do a renewal of vows or have a religious ceremony if that matters, but the actual legal marriage has already happened.

No matter what online marriage is illegal in Canada, if our marriage certificate states Utah it will be considered illegal in Canada. Talked to two immigration lawyers. This is even if we marry again in ph and rom issues the original ROM cert from Utah. Since we've never been traveled there it's illegal for canada

OK. It wasn't clear that you are in Canada (and presumably a Canadian citizen). This is a US immigration website so virtually everyone assumes that people ask questions with the intent of immigrating to the US.

 

If no, you are NOT planning to immigrate to the US, and you just want to get a PH visa to visit your wife, then your Utah marriage certificate should also work for the PH visa.

 

Do you two have any plans of immigrating to the US? Are you a US citizen? If yes, then the Utah marriage certificate is valid for your wife to get a US spousal visa. Note that USCIS will want to see proof that you met in person after the wedding, which the PH visa should take care of.

 

On the other hand, if you are planning for her to immigrate to Canada, and already consulted two immigration lawyers about it, and they told you that online marriage is illegal in Canada... I am scratching my head why you went for an online marriage and did not just meet up in a third country to marry in person.

Yup, by doing the Utah marriage OP's case is now more complicated. One option could be to live together outside of Canada for 12 months: https://www.cic.gc.ca/english/helpcentre/answer.asp?qnum=347&top=14

 

Otherwise, OP should ask the Canadian immigration lawyers if IRCC would accept a new (in-person) marriage somewhere (*other than PH since the Utah marriage would be registered via the ROM).
