Proof/Receipt of Filing to Remove Conditions?

Hi everyone,

 

The 90-day window for my spouse to file to remove conditions on his 2-year green card is next week. 

 

We're under contract for a new home, and our lender is asking us for proof that we're renewing his green card (obviously since my spouse is a co-signer, they want assurance that he'll be able to continue working after his current green card expires).

 

What can I use as proof that we've filed for ROC? Should I send the packet by certified mail and use the received receipt as proof? Or for the check to clear as proof? Or do I need to wait weeks for the extension letter to arrive? I'd prefer that this not to affect our closing date at the end of December, so I'm looking for the fastest way we can submit proof to our lender.

Extension will arrive at same time as receipt. You can use it.

 

Your landlord is making a mountain out of an anthill. I wonder how his status is tied to rent? 🤷🏽‍♂️

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Receipt notice will have a 24 month extension letter, you will get it in the mail a couple of weeks after filing a successful i751 application. 

 

Don’t even file one day too early USCIS will send it back, it is 90 days not three months.Best to file a day or two after the window opens not before.

 

Your LPR does not expire when your green card expires, only proof of your LPR expires when you have a pending i751 pending. Only an immgration judge can terminate a LPR in court.

Lender not landlord. OP is getting a loan to buy a house dependent on immigrant's income. I can see how this might be an issue.

Still shouldn't be.

Establishing a US presence is important to Lenders. If you cannot establish it, especially if your stay is illegal, you can be a flight risk to the lender, and they might never see their money again. Can you see why it's important for them to keep track of your status at the country?

OP's spouse is not illegal, hence my sentiments and as such, this statement does not matter in this circumstance.

However, yes, if you are illegal, I understand. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

They will be out-of-status if they do not apply for an extension. That's why a Lender cares to make sure you are doing all you need to do to continue your legal status as a LPR.

This is a question to the loan officer, not VJ. They will all accept different things, and will all require different documents. 

 

I'm sure VJ can share experiences. From my experience, my nearly-expired by 3 weeks card satisfied the requirement, and the pay stubs and employment letters carried far more weight. But you need to talk to the LO to see what they're expecting exactly. They're trying to close as much as you are, so they'll be helpful where they can be. 

2015-11-23: Last TN received at CBP

2017-06-12: Married

2018-06-25: Mailed I-485, I-864, I-130/I-130A, and I-765 to USCIS

2018-07-24: Biometrics appointment

2018-08-28: Expedite request submitted for EAD via USCIS support line

Partially correct or eventually correct you lose your LPR status in immgration court when a judge revokes your LPR, if the immgration judge has not done that you are still an LPR. If you don't file a i751 you will be put into removal and eventually lose your LPR and perhaps deported. One can still file an i751 at any point up to revocation by the judge.
