IR-1 Interview Complete, but had a previous overstay

Hello all,

I just had my IR-1 interview in Montréal and it went very well, and the interviewer said that he will approve me. I am awaiting my passport in the mail.

This year, I visited the US on my B2 visa and needed to extend my visit due to the pandemic and a few unexpected health issues that made it difficult for me to travel at the time. I filed the I-539 before my I-94 expired and left the US before a decision was made (but after giving my biometrics). I brought all of this documentation to the interview anticipating that they would ask me, but it didn’t come up at all.

Now I am wondering if I should have volunteered this information myself and if this could cause issues when entering the US at the POE. I am currently six months pregnant as well, so I am getting quite anxious and also quite frustrated with myself for not figuring it out already :(

Please advise me on what I should do. Should I reach out to the consulate? I do plan to take proof of my extension application to the POE, in case the officer there asks me about it. The idea of being denied there or waiting for a long time (with a newborn by then) is scaring me quite a bit. Thanks everyone.

So why exactly would you want to volunteer information you have not been asked?

I’m not sure if it will be an issue when I try to enter the US at the POE, that’s why. I’m just overthinking the possibility that they might deny me or give me a hard time over it...

Nope, no consequence.
