I contacted, state senator's office as well as local congress woman's office and they both put an inquiry on NVC. Let's see what happens.

 

I spoke to a lawyer and he advised me to sue the state department since this is my second marriage.

 

I also called NVC again and spoke to the supervisor and he advised me to email nvcexpedite and they also denied the expedite request saying, people are still in front of me and it wouldn't be fair to them if they pull my case ahead of them which is BS lol

 

So tbere is not that many options left for me and just have to wait I guess and see what happens. I hope my case converts to IR-1 next week since it's my second anniversary and then they can schedule it afterwards. Fingers crossed.

No i have filled it as single as she don't have SSN. Yeah just emailed local congressmen, hoping he can help me out.

You can apply for your wife's ITIN and then file as "married and filing jointly". Do this if you haven't filed taxes this year. Research for more information online.

Yup you guys will get it soon i guess, because from what i'm observing. People have been getting interviews who DQ's from January 2021 to June 2021. I don't know about my case since neither NVC or Mumbai consulate giving me any clear information.

They don’t give any clear information. Even our lawyer said she doesn’t know.

I already did my taxes and will get another letter for my husband. I figured it’s more important to show my income. I have plenty other documents that he is joint beneficiary on to prove we are married. I tried last year and was told he had to be here with his green card and we apply for tax ID in person. That’s what tax office said when I went there.

Does it matter  if you filed previous year tax returns as single? And would it be the reason for getting my case skipped by NVC? FYI when i call NVC they say everything is fine from your side. You don't have to do anything from your side.

Not as a single. I hope you meant married and filing separately.  Which is okay but according to me the best is "married and filing jointly". After she is here next year you can file separately or jointly by opting the one that fetches more money. For now "jointly" is the key word.

 

I am not a lawyer. I am just using my software engineer logic. 😀

I was unaware about this. I thought i couldn't file tax return as married as my spouse is not in US and doesn't have SSN. So i filled it as single. I got married in Dec 2019 and filled my 2019 & 2020 tax return as single. My case got DQ'ed in Dec 2020. So technically based on 2019 tax return i file as single and NVC approved them.

No you cannot file as single when you are married. This is reason why consulate is delaying your interview letter.  Approach a good tax consultant and take their advise.

Oh okay. But whenever i call NVC and i ask them if I'm missing anything on my case they say your case is documentarily qualified and NVC have all the documents we request for. Your application is now waiting for an interview appointment. So don't really know what to do.

NVC checks for the dollars on the returns. That is what they are trained for i think. Why do they care in what category you filed it. 

Please consult an immigration attorney or a tax consultant and explain your situation. 👍

I saw a tax consultant last year and they told me my husband had to apply in person. My lawyer said that it can be a red flag if you file dingle, and asked me to get a letter explaining that he is not here so I’m filing single. He didn’t work this last year because of the pandemic so it’s just me filing. I don’t think that had any bearing on your interview. My attorney would have told us. The documents included the letter that I filed single and they accepted it. They care more that you made enough money to prove support.

Exactly. I’m going to get a letter again since I just filed. I went to H&R  block because that’s the only place that I found deals with getting tax ID they said he had to be here and do in person. So that’s what I’m going on. Interview should be soon and I wanted to be sure to have this last years transcript.
