Hi all! I am submitting my wife's civil documents. One of the listed items is photographs. I thought photographs are not required to be uploaded since she will have to take them with her to the interview. Am I missing something or should we just go ahead and upload photographs? Appreciate your input.

Thanks

you still need to upload passport style photos even though we are required to take them with us to the interview!

My spouse got DQ'ed by NVC in December 2020 and I am yet to receive interview letter. I have been seeing people getting interview letter for IR1 category DQ'ed in June 2021. If its true that means my case have been skip. Does anyone know what to do now and get interview schedule for my spouse. I have talked with NVC few times but they aren't much help? Does anyone know what can be done?

Sorry to hear this.

Question - did you file taxes as married filing jointly last year?  You might have done this already ...just contact your local congreeman's office and followup regularly. 👍

Call you local congressional rep. Depending on the state you live in they may be supportive. I'm In California and the area I live has a very good congressman who cares about immigration. They had me file for expedited interview which we knew was going to  rejected. So now they send a request to the state Dept. every two weeks asking where is our interview. I do nothing and she emails me to let me know that they are still reaching out to the consulate. This is awful and my heart goes out to you. Try this and see where you get.

Hello,

I contacted NVC again yesterday and spoke to the agent and I told the agent that, why is my case not being picked up and others are. The embassy is currently scheduling for May-2021 and he asked where are you getting this information. I said, I know few people who were momentarily completed after my and they already go their interview letters and the agent said, not unless they were expedited. Currently Mumbai is operating very slowly at limited capacity. I was like doesn't the embassy go by DQ date? and he was like we only schedule interviews on the bases of what embassy request us. So long story short, I asked for the supervisor and he said there is no one available at this time so he said we can schedule a call back, so I am expecting call from them on march 2nd.

I also reached out to my local congressman's office and gave them my info and told them about my experience with NVC. They said, they will request an inquiry and get back to me.

I am not sure, how much it helps but my question is, what am I supposed to do now? Do you think if I hire an attorney and they would help investigate?

I don't think hiring an attorney at this point will help expedite your case. They won't be able to pressure to get to an appointment. I think your best bet is to get the Congressman's office to try and get an update. Are you still waiting for an interview date? Another option would be to email the Consulate in India. I don't know how much success that will provide but may be worth a try. Email: support-india@ustraveldocs.com I would suggest you include your NVC case number and details so they can provide a response. Good luck.

I have files as single as well for the same reason. My attorney asked me to get my tax preparer to write a letter saying that we couldn't file as married because of this.

That was what she submitted to NVC and they accepted it. We DQ'd Aug. 2021 without NVC asking for anything else. Good luck.

But whenever i call NVC they keep saying you don't have to do anything from your side. You just have to wait for your interview to be scheduled from Mumbai Consulate.

Yes, once your documents and fees are accepted at NVC you have to just wait for the interview to be scheduled. We’ve been waiting since August 2021. And even my lawyer says they don’t give her any timeframe. But the couple who are DQ a month before us she said got IL. So hopefully not too long for us.

Yup you guys will get it soon i guess, because from what i'm observing. People have been getting interviews who DQ's from January 2021 to June 2021. I don't know about my case since neither NVC or Mumbai consulate giving me any clear information.

If anyone is interested, here is the link to the new Whatsapp group for spouses awaiting interviews at Mumbai. The old group was unceremoniously dissolved yesterday.

So filing as Married Filing Jointly could be a reason for getting skipped? My husband has been doing this for the last three years after getting an ITIN number for me.

Not filing as married and filing jointly could be one of the reasons. This is just my assumption.
