Hello,

I contacted NVC again yesterday and spoke to the agent and I told the agent that, why is my case not being picked up and others are. The embassy is currently scheduling for May-2021 and he asked where are you getting this information. I said, I know few people who were momentarily completed after my and they already go their interview letters and the agent said, not unless they were expedited. Currently Mumbai is operating very slowly at limited capacity. I was like doesn't the embassy go by DQ date? and he was like we only schedule interviews on the bases of what embassy request us. So long story short, I asked for the supervisor and he said there is no one available at this time so he said we can schedule a call back, so I am expecting call from them on march 2nd.

I also reached out to my local congressman's office and gave them my info and told them about my experience with NVC. They said, they will request an inquiry and get back to me.

I am not sure, how much it helps but my question is, what am I supposed to do now? Do you think if I hire an attorney and they would help investigate?

I agree with other response. You need to be patience.

This is not true. All the people who have been getting appointments are not expedited. Just yesterday my lawyer told me that a couple who was a month before my husband and I, just got I and are scheduled. Call your congressional representative. Also they should be operating at full capacity again.

Hi!

An attorney won't be able to help you in in this case. I saw few people (on the facebook group that I follow) were skipped this time too by NVC. But, just be patient for a little while (i know that can be frustrating) but many people from dec/Jan who were skipped earlier have started to receive their letters. Nobody knows the reason behind them skipping. Not all the cases who got letters are expedited. I am not sure about the congressman's office, that might be helpful but nothing else will help.

I agree I bet you will  get soon🙏🏽

Just curious. You both are filing US taxes jointly since marriage, correct?

Sometimes you cannot file married. I'm married three years this May. Because my husband is still in India he has no social insurance number and no tax ID. I had to get my accountant to write a letter stating that I can't file as married until he is here. I did name hm as my beneficiary on all my accounts that I could and I will be bringing copies for him to bring to interview once it's scheduled, she can show if need be. My attorney agreed.

But you can apply for his/her ITIN number when spouse is still in india. And can file taxes as "married and filing jointly".

This is just my vague assumption ...."consulate might be doing their style of verification before sending a IL". You will get it please be patient...all the very best!

Nothing to stress out. It is just one of many legal ways of proving to the consulate that you are married. That's it. Now they will have their own ways to prove that fact.

Be patient. When attorney agreed what you did is correct too.👍

If you haven't submitted tax returns yet please apply itin and submit. An authorized agent can do this from india. He can do both at the same time. i.e. apply for itin and submit taxes paperwork.

No can't file jointly, since she is not here and doesn't have SSN yet.

It is not possible when your spouse is not here in the states. NVC knows this but make you jump through the hoop of getting a letter stating this. Or maybe not. My lawyer asked me to get one last year before we were DQ’d to be sure it would not slow anything down.
