AOS from K1 - how do I know I have required vaccinations?

Hi everyone,

 

I am a K1 fiancée who recently got married and now filing for AOS. I am confused whether I need to see a civil surgeon here in the US. 

 

I forgot my password for the old account so here’s a brief summary: 


May 2021 - had medical in London

July 2021 - got a K1 in London, UK

End of September 2021 - entered US
Quarantined for 2 weeks

End of October 2021 - got married

 

I am not from the UK originally, but have been living there for some years, and even though I had all vaccines required as a child/teenager, the medical records were extremely complicated to get back from my home country and I could not leave due to the nature of my work. Hence since we started the K1 process in the UK, I’ve been getting all vaccines in London to get them on the record in English.


When I saw the panel physician in London, the doctor said I don’t need any vaccines currently and will only need to get a Td booster within the next ten years. However, she ticked the box that I selected to not be vaccinated. 

 

1) From what I checked on USCIS manuals, CDC material that are referenced and forum discussions here, I seem to have met the requirements for vaccinations, but could someone please correct me if I am wrong? 2) After the visa medical in London, I got another dose of Td from a new GP (NHS refused to give me one earlier prior to my medical claiming not enough time passed), a flu shot and two shots for Covid before leaving for the USA. I understand there’s confusion regarding whether Covid vaccinations should be certified by a Civil Surgeon.  Since my medical was in May, and I plan to file for AOS in November/December, will my DS-3025 be enough?

Your vaccination is not complete, it says that on your copy of DS-3025 - “K1 applicant elected not to be vaccinated at this examination”. If it were complete then another box to the left side would have been checked - “K1 applicant voluntarily completed vaccination requirements”


You will need to find a USCIS designated civil surgeon who will be willing to transcribe vaccinations only. Most of the time they will make you go through another medical to make $$$.

I’ve seen other posters get marked the same check box simply because they didn’t have flu jab during the non flu season in the UK. They sent the form and got approved for GC. As per USCIS requirements, only one recent Td is required, and everything on my form is either marked with a date or waiver. I was asking for guidance regarding that discrepancy. If there is one official document listing the vaccine dosage required, I’d appreciate the link, as the info on USCIS manual and CDC differ and is not as clear.

 

Also, no one asked me if I want to be vaccinated at the visa medical, as I already mentioned I was told I won’t need a vaccine for the next few years at least. Just trying to figure out whether it is a mistake I overlooked or if I am actually missing some vaccine that should be administered so I could take care of that.

I see what you mean but your DS-3025 was not completed correctly by the panel physician. He or she should have marked it as complete since you received a blanket waiver for “not routinely available”.


This is my personal opinion, but I think you will have to see a civil surgeon still per I-693 instructions (page 8):

 

“Even if a new medical examination is not required, you must still show proof that you complied with the vaccination requirements. If the vaccination record (DS 3025) was not properly completed and included as part of the original overseas medical examination report, you will need to have the Part 10. Vaccination Record completed by a designated civil surgeon. In this case, you must submit Parts 1. - 5., 7., and 10. of Form I-693.”

Yup. Should have questioned that when you're at the NHS and they handed the form to you. You can surely wait till the interview and see what they say and if they require you to get it done or if you get lucky like the person you're talking about but the way it is your medical doesn't fit the requirements.

Similar situation here. My Fiancee - a Russian National was granted a K1 back in July and we entered the US in late August. Since we couldn't pull any of her medical records from Russia (we were in Thailand at the time), we had to get them in Bangkok. Naturally, we have the completed DS-3025 with all of the required vaccinations.

 

HOWEVER:

 

It has come to my attention that the USCIS is now requiring all applicants to be vaccinated against you-know-what.

 

We both got our second shots at the end of September.

 

So my question is: Since she had her USCIS medical exam on the 31st of May, do we need to submit any extra proof and skip the I-693? Or do we need to take her vaccination card along with our copy of the DS-3025 to a civil surgeon in the US, so that they can "sign off" that she was indeed vaccinated as required by USCIS?
