Confusion on tax return transcript for I-864

After your input I got it. I have gotten it now. I have done what you said. Gotten current income and pay stubs I also re read the notes/ instructions. I have W2s and as such do not need my in laws income.

You are still talking about 2021.  It's 2022 now.  I their pay is the same, then your husband's current income is $48k.  As such, probably no need for a joint sponsor.  Current income is King here, not past taxable income.  Consulate in India would be an exception.

 

After reading your later responses, I'm not sure you really get it yet. Until you get the US Citizen sponsor involved in this discussion, I foresee further problems and delays.

I did talk to my husband and he doesn’t do his own taxes so he was completely clueless. I have gotten all the info together that you both said so I’m going with that. The current income like you said. I have the evidence too

Thanks very much for your feedback and patience. I’m pretty certain this all could have been resolved with a simple 5 min call but since we don’t have that option confusion became my best friend. Nonetheless I have learned so much from you that I am certain I have the right information and  background knowledge now. 
 

I have collected the documents (W2s, paystubs and, letter from employer I-864), discarded the in law I-864 and documents and gotten all the evidence for the current income as mentioned should for ONLY my husband. 
 

again, I truly am grateful for your patience and invaluable guidance. My husband simply gives his W2s to someone who files his taxes and never even looks at them again, so thank you for your input once again. 
 

my interview is next month I will let you all know the outcome (just in case you’re wondering)!

You do not need W2s from 2020 because you have a transcript for 2020.
 

I-864 Instructions, page 8:

If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms (W2s) if you provide an IRS transcript of your Federal individual income tax returns. 
 

Take to your interview

  • Form I-864 (correctly filled out) 
  • The 2020 tax return transcript with no W2s
  • The last  payslip from 2021 that shows a YTD of $48k
  • An employer letter that says he is employed full time and makes $xx,xxx.xx per year. ($48k?)

Ugg.  The last pay stub from 2021 is a nice touch but it does not reflect current income.  Current income can be documented with the most recent pay stub.  For the employed, current income may or may not be equal to last year's earnings.  If you get a new job today, making 1000 a week, your current income is 52,000.  If you lost your job yesterday, your current income is ZERO.

 

Employer letter is not needed if you have a current pay stub.

Facts are cheap...knowing how to use them is precious...

Employer letter is not needed if you have a current pay stub.

A pay stub that says $48k YTD is sufficient to show he earns enough to surpass the requirement. It’s less than a few weeks old. An employer letter is good because London LOVES employer letters. Just trying to keep it simple with something that will pass at a London interview.  Just hope the I-864 is filled out properly. People mess those up all the time.

A pay stub from December is not good evidence of current income in March (for example).  The most current pay stub can be scanned, emailed, printed and taken to the interview.  Simple simple, but also BEST evidence of current income.  I've never seen any evidence London will delay visa issue to get an employer letter INSTEAD OF a pay stub.  Have you?

I don’t think I’ve seen them delay for either.  They just glance at it while you’re walking to the window and usually don’t even discuss it if it looks okay. London tends to be real easy on the Affidavits of Support. 
 

And the instructions say six months of pay stubs. I thought you were the one who always said that was ridiculous if you had an end of year one that showed YTD exceeding the requirement.  And they will have a new W2 for 2021 in a week or so which would work for London as well.  
 

Make list of your own and she can pick one.

You misinterpret.  A pay stub that shows year to date income give all the information so far than year, so if it's a July pay stub, it already documents six months of income if the job has been steady all year.  The YTD issue is not about whether the income YTD is sufficient.  Sufficient YTD income is not part of the criteria.

 

One pay stub from a brand new job is enough to document current income.  If you're making a thousand a week now, your current income is fifty two thousand, no matter how long you've had the job.  At the same time, if you lost your job yesterday, your current income is zero, no matter how much you made so far this year or any other year, or any other time period.

I just wanted to come back and say thank you all so much we have since been approved for the visas, following the advice and clarity provided here for the documents in question.
