All they wanted is 2 missing doc 1 is which court record and passport back. Someone said they would have denied at interview but they didnt and asking for missing documents and my passport back thats a good sign so idk..

As far as denying a visa is concerned, if you have presented everything truthfully and correctly then that's the max you can do. They have to make a decision based on their own parameters. I am positive if the case was dismissed and all then you should be OK 👍 

 

I am not in the same boat but recently had a discussion with a petitioner who was actually incarcerated for over 3 years in a federal prison on a federal charge (conspiracy) and he was able to get his beneficiary here without any issue. They grilled the daylights out of her asking her/telling her about the minute details of his criminal history but in the end the visa was issued based on their relationship being considered bona-fide.

 

 

 

 

  • Jan 26, 2021 = NOA 1 for I-129F (K1 Visa application)
  • Sep 8, 2021 = NOA 2 for I-129F (K1 Visa application)
  • Nov 16, 2021 =  K1 visa issued in Islamabad, Pakistan
  • Jan 20, 2022 = POE Dallas, Texas
  • Feb 14, 2022 = AOS (I-451, I-131, I765) Filed
  • Feb 20, 2022 = Receipt notice for all three received
  • March 21, 2022 = Biometrics in Dallas, Texas
  • August 9, 2022 = EAD (I-751 approved)
  • August 13, 2022 = EAD and SSN received (SSN applied with EAD)
  • September 6, 2022 = AP (I-131 approved)
  • September 13, 2022 = AP (I-131 receieved) 
  • March 15, 2023 = I-485 approved (interview waived, New SSN received without DHS wording)
  • March 31, 2023 = GC in hand (Total time from NOA-1 to GC in hand 794 days)

The petitioner having a criminal record is less of an issue (unless it's Adam Walsh related): they will grill as.a means of ensuring the beneficiary knows who they are marrying.

 

A beneficiary having a criminal record is different.  The information is less about the relationship being bonafide and more - in my opinion - about trying to figure out if the beneficiary would be a criminal risk once in  the US.

I mean people get arrested all the time and anyone can get arrested even if innocent and people also get falsely charge for something they didnt do. I dont think a charge would cause such issue if case was dismissed as it was mentioned to the judge showing the person is innocent.. Isnt it suppose to be more difficult if was convicted, fined or sentenced ? 

 

I know no one can tell the outcome, only the officer, but i 

Really trying to find out if anyone here been through this and got visa and how did the consular reacted to the dismissed case.

Yes! Im staying positive because i was innocent in that case and im still innocent.

Completely different situation for a USC with a record vs an alien with a record wanting a visa…..
