Hi everyone,

 

I have the interview for N400 coming up and one of the documents they requested to be brought to the interview is the "your spouse's birth or naturalization certificate or certificate of citizenship." My spouse derived his citizenship through his parents as he was under the age of 18 when they became citizens. He has a US passport which has met all of the requirements when asked for proof of US citizenship. Do you guys see any issues if we brought his US passport to meet this criteria. Getting a certificate of citizenship takes 1-2 years.

At this time your spouse's PP is the only proof of citizenship you can bring. So just go with it and bring a printout from uscis mentioning CoC being optional. If the IO asks about CoC, show that printout.

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

Would he happen to have a copy of his green card? Would your fil or mil be willing to loan you their naturalization certificate and marriage certificate?

I will do that. So far any of the time that a CoC has been requested we have just given passport copy instead and have not had any issues. Thanks for the reply

We do have copy of his green card and copy of his parents naturalization certificate but no copy of their marriage certificate. You think we should take them to the interview?

Every interview is unique but the Officer who interviewed me didn't ask for any of the documents noted on the interview notice letter.

I had an issue with getting the original birth certificate for my husband at a time & did some research, and from what I've found at least on this forum - the Officers rarely ask you to show any documents during the N400 interview (besides your own passport / greencard). 

 

But even besides that - I am 99.9% positive you'll be fine with his passport.

03/16/2021 - day 1670 - N400 Interview - passed; due to I-751 stuck in another office 'No decision can be made at this time'

06/01/2021 - day 1747 - with help of Sen. Sanders' office, I-751 file finally forwarded to St. Albans field office

06/28/2021 - day 1774 - I-751 status changed to 'New Card is Being Produced'; N400 status changed to 'Oath Ceremony Will Be Scheduled'

08/19/2021 - day 1826 (exactly 5 years since day 0) - Oath Ceremony (notice received on 7/19/21)

That's very reassuring to hear. I will just take the passport and hope for the best since there isn't a alternative that is available.

Yes I would bring those plus his birth certificate and translation thereof.

Was your husband born in the USA?

The passport is really all that is needed. Your husband's green card has his A number on it.  If needed USCIS can retrieve his history with that.

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Bring what you have (you obviously can't bring what you don't have). I'm 99% sure they won't even ask to see your spouse's documents anyway, neither passport, birth certificate or anything else.
