Will health insurance for k-1 fiancé through ACA marketplace violate my affidavit of support?

I'm getting mixed message even from our lawyer. My fiancée just arrived a week ago on a k-1 visa. I'd like to get her health insurance asap. If you're a k-1 visa sponsor, you know that we all have to sign an "affidavit of support" promising that our fiancé will not become a public charge by using programs paid for by tax dollars. (Not to be confused with Trump's "public charge" issue that has been dropped..) I cannot put my fiancée on my work insurance. She is a medical professional. When she can work, I'm sure that she'll have good insurance. Question for now - If we purchase health insurance through the ACA marketplace, will that count as violation of my affidavit of support? I'd love replies from others who have already discovered the solution for themselves. Thanks!

Not an issue.  If you are really not able to add your spouse-to-be to your workplace health insurance plan, then go ahead and look through marketplace.  Just note that she will not be eligible until after she files her I-485 package.  So get married and file ASAP.

 

By the way, SSN is not required to sign up for health insurance.  Still, if your fiancee does not have SSN yet, it is strongly recommended for K1 visa holders to apply for SSN soon after US entry, preferably before getting married.
