Hello ladies and gents,

I would really appreciate your help if you can chime in your insights.

My wife is currently on a 2 year conditional GN, which she got August 2021. I just found out that i have been offered a good job which requires us to move from KS to GA. However, I, as a petioner, recently received a traffic violation (is considered as unclassified misdemeanor in KS). I can apply for a traffic diversion once i go to the court hearing. However, i estimated that the court hearing will be somtimes in Jan or Feb 2022, and that will not look well with my new employer. 

If i plead guilty with the charge, and this is my first time, how will it affect my wife's removal condition progress when she is starting to apply in May 2023? 
I love her so much that i am willing to back out of the accepted offer with the new employer if it will affect my wife's case.

ROC is just the process to show that the relationship is still "bonafide" and it has nothing relate to your traffic violation.

Only if you are convicted of abuse of a minor with the Adam Walsh act, the only criminal offence that bans US citizens from sponsoring a loved one’s green card. Your spouse already has their green card so you passed that point of the immgration process.

 

The ROC i751 application is the green card holder petition not the US citizens. I751 applicant is the petitioner and the beneficiary the USA spouse is only the spouse. The US based spouse simply signs as a spouse in a joint i751 case, and not at all involved in a i751 waiver case (devorce, widow, abuse).

 

At this point USCIS is looking at whether or not the green card holder is in a bona fide marriage with the USA citizen spouse required to remove the condition on the LPR.

 

Only the petitioning green card holder gets a biometrics update to check the green card holder’s background so they are screened for criminal activity, not the spouse.

Even if she was still in AOS, this would not affect her case. As others have said, only abuses of a minor would hurt her case and even then, for ROC she’s the only petitioner. You just need to sign the joint petition, where you’ll prove a bona fide marriage, and attend the interview if you have one. I suggest you get more acquainted with the process.
