@ice-qubehave you taken the action of WoM lawsuit?  Unfortunately, sitting ideal and hoping that they will pick up the slack is not a strategy.

 

I tolled through 4.5 years of wait (3 months of i-140 even with premium, 6 months of NVC processing, 39 months of bunch of nonsense (retrogression, visa bans, shutdowns, backlogs), 6+ months of AP (including lawsuit time). What I realized is that I should have long taken the action of WoM and that could have shortened the wait.  Don't wait; take action and then let the destiny take its course!

I am considering the mandamus lawsuit. However this involves a ridiculously large cash outlay that could be put to be much better us, and even on principle alone I do not want to do it, so it is really not going to be easy for me to go through with it.

@EB_StuckYour immigration journey just shows that it is in desperate need of reform .  Congrats on the lawsuit! A wait like that is beyond unacceptable.  I’m Canadian EB-2 myself and my Priority date is July 2019 and DQ date is January 2020.  Something like 841 days I’ve been waiting.  They put us employment based the back of line for more than two years to just have our cases just sit and collect dust.  Interview was finally March 2022 told to get a waiver and got approved quickly now I wait all over again.  This is not for the faint of heart.  Not to mention mental health.  No response from Montreal to waiver approval or emails.  I wish all the best!

So my case was saying REFUSED with last update Mar 21 but then yeasterday it said something like CASE AT NVC and that I should log into my nvc account for further instructions. Just keep an eye on it. Sounds like a glitch- but who knows. 
 

Maybe email them and say you saw that it said your case was at the NVC and ask them to confirm where your case is.

Regarding asking for my passport back…

 

1. Did you guys bring up your pending visa at crossing or no?

2. Did you guys keep your job and go on leave or just quit?

3. Did you guys have any other issues with crossing?

4. How many days did they say you could stay?

 

I’m a very nervous Nelly and I just want to be with my fiancé. 🥺

Maybe not. We have seen people get approval about a month after their last update, so it might still be a positive sign. Hoping you will hear some good news in the next 3 weeks.

1. Yes, when asked how long I was visiting (3 months) I mentioned I may return sooner if my K-1 Visa finishes processing at Montreal Embassy. He followed up by asking me to clarify which visa.

2. I kept my job but have been on a leave of absence.

3. No issue, standard questions besides the aforementioned visa inquiry.

4. I mentioned I was visiting until July (entered March).

 

I made it a point to include my K1 visa processing in my questioning to be completely transparent.

Agreed, some sort of movement happens a bit after last updated date.

USCIS

January 8th 2014 - NOA1

July 10th 2014 - NOA2

NVC

July 17th 2014 - Case shipped to NVC

July 30th 2014 - Case received by NVC

August 13th 2014 - Case number and IIN received by email

August 13th 2014 - DS-261 Form Completed

August 14th 2014 - AOS Fees Invoiced and Paid

September 17th 2014 - IV Fees Invoiced and Paid

September 19th 2014 - DS260 Completed

October 6th 2014 - AOS and IV Packages Received

November 28th 2014 - AOS and IV Checklist (4 items in total. 3 for documents they lost. Called on December 9 and a rep said no checklist for IV....go figure)

December 8th 2014 - Checklist scan date.

December 30th 2014 - Case Compl........NOT. So after not having an interview date yet, I called again on Jan 30th and apparently its in final review with a supervisor.

February 6th 2015 - Case Complete: Supervisor called from NVC to confirm everything has been completed now.

March 27 2015 - Interview Date

March 27 2015 - Approved!

On average, how many times does a case get updated before approval/issued? I got at least 4 updates (that I for sure remember) in the last month, but it might be more around 5 or 6...I didn't know to look out for those until later. My case is not from montreal embassy, however, my country has no tracking info and this thread is the most informative one I have found. Hope you all get "issued" soon❤️
