Hi, 

 

Just wanting some advice from people who have been through the k1 process. We have a financial sponsor as my fiancé is a student and earns just below the poverty line, however, we are having some issues with their taxes. Long story short, they had to file an amendment as the tax transcripts are wrong for their 2019 taxes, then their 2020 taxes got lost in the mail and IRS hasn't processed the ones they refiled, nor have they processed the amendment. We are wondering if it would be okay to have 12 months of payslips, the 1040's, the W2's, the unamended 2019 tax transcripts, an employment letter and a bank statement for the last six months/year to bring to the interview instead? Plus a letter with our sponsors explaining the situation. I am also going to ask the embassy whether this will be possible, but I just wanted to know everyone's thoughts? It's at the Auckland embassy if that helps at all :)

Sounds to me like it would work for Auckland, which is a pretty easygoing consulate.

 

One thing to think about though, is given your fiancé's situation, is a K-1 really the way to go?  You won't be able to work for upwards of 8 months, and living here on the west coast is very expensive.

Thank you so much for your reply :) That actually helps a lot! 

 

I know, we did consider that, but I also have quite a lot of savings that will last me upwards of a year, plus she will be transitioning into full time work in a few months, it's just the timing of it doesn't coincide with the interview :( but thank you for your concern! ^o^
