PROCEDURE AFTER BIA APPROVAL

Hi there my I130 interview was refused then NOIR Issusef by USCIS then revoked

 

I apeal EOIR29 to Board

 

My Question are if the apeal is approved

 

Will i have to pay NVC fees again or it will go automatically to Embassy ?

 

Will my case number at NVC will remain same or i will get new case number

 

Can embassy refuse BIA approved apeal on Interview ?

No need to pay fees again.  Case number should be the same, and yes, they can still deny the visa.  Winning an appeal after USCIS revocation, is extremely rare.  What is your basis for appeal?  You are really probably better off starting over.  Why do you think otherwise?

After noir we got revocation ,

 

Once we appeal ON EOIR 29

 

WE GOT NEW CASE NUMBER FROM USCIS

 

NOW THE CASE IS IN BIA

 

ONCE APPROVED ASSUME

 

WILL WE HAVE TO SUBMIT DS260 FORM AGAIN , PAY NVC FEES AGAIN

 

AS USCIS GAVE US A NEW CASE NUMBER

 

WILL BOARD SENDS CASE DIRECTLY TO EMBASSY OR THEY SEND TO USCIS THEN to embassy or BIA sends to USCIS then NVC then embassy

 

 

I know that case reafrimmed by USCIS can be denied by embassy  but case apprived by BIA can be denied again as well

I don't know the answer to your actual questions.  I would have a better idea whether you have a hope of winning your appeal, if you would explain what makes you think you will.  Like I said. You are probably wiser to start over instead of appeal.  I asked you why you think otherwise.

 

I'm not saying it's never happened but since I joined this site in 2005, I haven't seen a successful appeal.

Nobody can answer these questions since it depends on your embassy/ consulate and how backlogged they're. If you win your appeal you'll go back in line to wait for a new interview slot.

I did an appeal  to the Board

i won according to the Board of Immigration

but the notice said,   "marriage is shown to be bona fida "  and that i could reapply

but i had strong evidence that i provided with the 2 issues presented by the CO 

any appeal needs to show evidence of why the immigration officer was mistaken

my appeal took over a year in normal times 

 

whether they accept the appeal and declare the case is legit is totally up to the ACTUAL PROOF that that a mistake is made (hard to do)

and whether they send the case back to embassy with that case # ,  again is up to Immigration Board

as they could say OK,  reeapply

reappling means new case and paying all fees a 2nd time 

 

BTW  the Board took over a year in Precovid so this is a long wait

i had a successful one but my proofs were easy 

1 issue they said he did not know what books i read

i had emails from when we 1st met talking about reading

He said "yes,  she likes to read but she reads online researching things"

and they said What books?  i was researching information at that time for the 3 books my mother was writing and his answer was correct "no books ,  i was reading online for research"

my emails where dated so accepted 

 

2nd issue "the notice actually said "he would try to convert me to ISlam"  and i had a chat where i asked " do i have to convert?

and he said NO.  and i wrote back "good,  as i am not changing"

 

Everything was dated and even time stamped and these conversations and emails were long before we married
