Hello

Correct me if i'm wrong :

We will use a married joint sponsor which his wife is unemployed , he did his taxes seperately and he own a restaurant here are the docs we will submit :

Business License
Bank statement for the previous 6 months
Tax transcripts 20 /19/18
I864 for the joint sponsor

So we still need the i864a for his wife even he filled seperatly ?

The joint sponsor doesnt have any  w2 or 1099 , should we write a letter to NVC to explain that he doesnt have the w2/1099 and upload  it ?

His personal  IRS tax transcripts will work

Business tax returns are not "personal income"

Thanks for your answer if my Joint sponsor income is sufficient , does his wife still need to fill out the I864A ?

Yes definitely submit signed statements for each sponsor expalining why each of them has no W2 or 1099, note that all 1099 need to submitted (there are a few different types).

More likely than not, the NVC and US Embassy will want the Joint Sponsor's wife to file an I-864a.

Even if the joint sponsor reach the minimum income ?

Actually, in a situation where they file "married filing separately" this is not true.  It IS true when they file married filing jointly.  Most people in that situation would file a joint personal tax return.  As mentioned already, the business tax return is of no use for this.  The OP should double check the actual filing status on the joint sponsor's personal tax return.  If it's filed jointly, then providing an I-864a from the joint filing spouse, is best practice even if she has no income.  This is both a qualifying document and a contract.

Actually not necessary when submitting a tax return from a self employed person.  That there is no W2 or 1099 is obvious based on how sections of the form are completed.

Never hurts to provide an I-864a from a spouse even if they don't file jointly.
