congressman's office said k-3 is a waste

I contacted the congressman's office today and spoke to the office representative. He seemed to know a lot about the immigration process, especially for India. I was impressed with the information he had. However, his one comment left me confused. He stated that filing an I-129 doesn't help your spouse get here any faster. he called it a waste of time, money, and energy. However, from looking at the cases of other people here it seems that K-3 does help bring your spouse here couple of months faster because there is no wait time at the NVC. Am i correct or was the congressman's representative right?

In some instances the I-129F does move faster and you can bring your spouse to the US faster. I am guessing that the congressional respresentative was making mention of at some consulates the processing time is not any faster you have more than one petition tied up in processing and the fees you have spent. In my case we filed both petitions and they both were approved at the same time and arrived at the embassy within days of each other (this was before the new I-130 filing process). The consulate has the option of cancelling the K3 and they did in our case so it was a loss of funds in my case and our case was not moved any faster in processing. Also, coming from Islamabad the men are in long AR/AP and it does not seem to matter if you file the K3 or CR 1 with a big time difference and if you get hit by the AR/AP then no time is gained.

Any petition can be hung up at any of the stages in the processing from the submission of the first forms. Name checks can cause name hits, some cases are randomly pulled for review at any time as well.

K 3 does usually process faster but again alot of things factor into whether you get pulled for random reviews or the particular consulate.

Congressional aides usually deal with USCIS processing times and Consulates. They rarely see the whole process. The difference in CR/IR visa and K3 visa timelines from petition to visa is primarily at the NVC stage, where the K3 petition stays less than two weeks on average and the IR/CR tends to linger several months. Depending on the Consulate, that end can be significantly different as well. China, for instance takes a couple extra months from reciept of case to interview for CR/IR than for K3, so the overall difference in time is closer to 6 to 8 months on average. Canada is another example.

I saw you mentioned Canada, do you mean that the IR/CR takes much longer then the K3? I've noticed that there seems to be quite a difference between the Monteral and Vancouver centers. (I don't have a timeline or anything, I'm just asking questions to get more aquainted with the whole process.)

My husband and I opted for the K-3 route. It brought us together approximately 2-3 months sooner, which is what we preferred.

The AOS process is expensive, but it only took us a little over 3 months to complete. All in all, it was worth it to us...

EVERY situation is different. It's really a personal choice!

Via the Indian embassy (we went through Delhi), getting a K3 brought us together 5 months faster. And AOS was done in approx. 4 months. We paid a bit more (b/c of having to do AOS) but it probably saved me hundreds on phone bills!!!

So for us, it was not a waste at all. I guess you need to look at what center you are going through and what Embassy.

well my case will be forwarded to the delhi embassy. I am yet to receive my approval...so lets see if k-3 will be worthwhile for me. i hope it is though

I was in Alberta too. My K3 took 5 months. I am in the US now!
