Re-entering the US to visit

Timeline

I’ve just returned from a maximum stay in the US (3 months, time given through discretion from the border guard because of my pending visa), and I was wondering when it is suitable to return and visit again? I returned October 2021 and am hoping to visit for Christmas, 2021.

There is no hard set rule.  The general recommendation is twice as long outside the US than in.

 

So, if you spent 3 months visiting, then wait 6 months before visiting again.  But this is just a guideline.  A week or two to spend the holidays may be fine.  Multiple long visits (2-3 months) may lead to CBP wondering if you have weak ties or no ties to home and are actually trying to live in the US.

They may wonder why you are able to take so much time off to be here, especially since working remotely while in the US without a work permit is not legal.

You mentioned in another thread that you are Canadian.  The fact that CBP set your maximum stay to 3 months only means that they already suspect (more than they do most Canadians) that you may to try to abuse your B2 status.  You may still try to visit again, of course, especially if you have proof of strong ties to Canada.  Even if you are turned away at POE, it would not affect your K1 case.  I recommend going through an airport with CBP pre-clearance.

Hi there,

 

I am a Canadian citizen who is the beneficiary of my American fiancée petitioner. We have just submitted our DS-160 and our Packet 3 (exciting!)

 

The problem is, we were hoping to have a short visit (maybe 2 weeks) visiting the US for Christmas.

 

My question is: Will there be any issues crossing the border so close to the interview? Also, I had spent July-Oct 2021 in the States, so I'm wondering if that will be a potential problem as well.

Timeline

Bring the interview letter and any ties to Canada that you have.  Coming so quickly after a 3 month trip may raise additional questions.  Remember only US citizens are guaranteed entry into the US.

Hey - you might want to fill out your VJ profile which will help people give you better answers.  

 

You can attempt to reenter, but you will have to show STRONG ties to Canada.  Now that the borders aren't locked down in the same way that they were during the height of covid, there is more eyebrow raising scrutiny.  Lease agreement, employment letter, return ticket to get back to Canada are all quite helpful in indicating those ties.
